I cant update my ipod touch 2gen. Stuck on iOS 3.1.3

My iPod 2gen wont update. It says its up to date but is on iOS 3.1.3. I've tried to press update and restore it (several times) but still refuses to update. Hope someone can help

Are you sure you have a 2G iPod? Those can go to 4.2.1 and requires iTunes 10 or later on the computer.
If your iPod does not have volume buttons on upper left edge or an internal speaker it is a 1G. A 1G can only go to 3.1.3

You will need to do a DFU restore by holding the home and power buttons down (while the device is plugged in to your computer) until the device's screen goes black and as soon as the screen goes black, count down from 3 and release the power/sleep button, but keep holding down the home button. Then, iTunes will say the iPod needs to be restored. The restore process will take some time and even though the iPod may appear to be frozen, don't interrupt the restore.

if your ipod has only 8GB then it is an icompatible old model ( 2nd generation iPod ).
IoS 4.2.1 on it indicates that it is a too old model.
Only 3rd and 4th generation can be upgraded to iOS5.

This was the scenario:
The first time I updated, it was only my music that was lost.
When I got my music back, I lost my apps.
When I got my apps back, my contacts, notes and photos were lost.
Now I got back everything except for my photos.
(Yes, I restored from backup several times since the first update.)
Do you think if I try restoring from back up, my photos that were taken from my ipod will be restored finally?

You can only update via the ipod with ios 5 or later.
You need to update via itunes on your computer as always.

Try quitting the app out of your multitasking bar, and then resetting (hold power an home buttons til device shuts off and comes back on).
