I have a cable 3 broadband connection with 100mbps download and 2.33mbps upload. On Windows 7 Home premium SP1 system on my desktop.
My internet connection is personal connection.
Since posting this issue I have uninstalled my creative cloud software and reinstalled it, and it seems to working now, with the exception of having to always sign in to my account all the time.

ok so when i go to the app store on the touch i noticed that the currency was wrong and so i tried to get on iTunes and it wont work

So it sounds like the iTunes Wi Fi store app on the iPod is causing it to crash. Sometimes connecting an iPod to a computer will temporarily resolve that issue, but there are some other steps you can take in the meantime:
Power Cycle the iPod
Hold the Sleep/Wake button (on top) until you see a red slider that says "Slide to Power Off." Drag the slider across the screen to allow the device to power off. Wait 10 seconds, and then press that button again to turn it back on.
Reset the iPod
Press and hold the Sleep/Wake button (on the top) and the Home button (on the front) together for about 10 seconds, until you see an Apple logo. (You may see a red slider prior to the Apple, that's OK, but just ignore it). When you see the Apple you can let go, and wait for it to restart itself.
Reset All Settings
Settings > General > Reset > Reset All Settings

When you tried syncing, did you connect the phone, then click on the phone icon near the top left of iTunes, then click on Apps under Settings in the sidebar, then find the app in question and click the Install button beside it before clicking Sync at the bottom right?

actually its not in DFU which is suppose to be a black screen. When it powers on there is an image of Itunes logo and the usb cord. What happened is I did an update before I backed up my photos the phone worked great after the update no issues till it powered off. When I turned it on again it had those two icons and was forcing me to sync with Itunes to system default which will wipe out my media.

While you're in itunes, with the leftside window open, click on Apps. Then, look across the top middle of your itunes screen. You will see several choices: All, Iphone/iPad Touch, Ipad, Ipod Games, List, and Updates.
Clicking on each of these gives you a different view.
When you select ALL you will see all of your apps. When you select Updates you sill see only the apps that need to be updated. When you are in Updates you will see the Update button in the lower right corner.

Replacements via Apple tech support are usually refurbished units, not new stock, though none of us here can say with certainty what you will receive. But you will not be able to tell the difference between new stock and a refurbished unit, and refurbished units generally go through more extensive testing than do new units, so getting a refurb may well be better than getting new stock.
