There is no iCloud icon because iCloud is a service, not an app. You create an iCloud account by going to Settings>iCloud, signing in with your Apple ID and turning on the data you wish to sync with iCloud.
However, you don't need an iCloud account to redownload your music from iCloud. It downloads from the iTunes store, not from a personal iCloud account. This article explains how to do this: http://support.apple.com/kb/ht2519.

Then you haven't upgraded to Mountain Lion.
Check inside your /Applications folder for something like "OS X Mountain Lion Installer" and double click it. If the file doesn't exist, you'll have to downloaded/buy it from the app store.
If you did make the purchase already, open the app store (under the apple >> app store) and then click Purchases at the top of the app store window. It will ask for your apple id and password. Do you see Mountain Lion listed? If so, then download it. If not, click on Featured and look for mountain lion in the side bar on the right and you'll have to buy it.

iCloud requires OS X Lion (10.7.2) or higher. You will need to upgrade to either Lion or Mountain Lion in order to set up iCloud on your Mac. First check to see if your system meets the system requirements to upgrade.
Lion system requirements are:
Mac computer with an Intel Core 2 Duo, Core i3, Core i5, Core i7, or Xeon processor
2GB of memory
OS X v10.6.6 or later (v10.6.8 recommended)
7GB of available space

If you can run Mountain Lion, you can purchase an upgrade from the Mac App Store. If you can only run Lion, contact the online store in your country and purchase a download code to download it from the Mac App Store.

Other people have been having similar problems with songs over the last few days, I assume that there has been a problem with Apple's servers.
Depending upon what country that you are in (music can't be re-downloaded in all countries) then try deleting those tracks from your iTunes library and redownload them via the Purchased link under Quick Links on the right-hand side of the iTunes store home page on your computer's iTunes : re-downloading.
If you aren't in a country where you can re-download music or if they re-download in the same state then try the 'report a problem' link from your purchase history : log into your account on your computer's iTunes via Store > View My Account and you should then see a Purchase History section with a 'see all' link to the right of it ; click on that and you should see a list of your purchases ; find those songs and use the 'Report a Problem' link.

I believe that all audiobooks are supplied to Apple by audible.com, so I assume that it's them requiring the one-time only download. This happened to me with the same device. I wouldn't worry about having it just say other as that is just information, if you really need to know what is using the most of your device's storage to to Settings > General > Usage > Manage Storage and that will tell you what apps are using in terms of your storage. Besides that, "other" is just iTunes knowing that there is information, how much there is, just not what it is. So syncing your device a few times and letting it stay plugged in should allow iTunes to recognize what information is on your iPod. Hope I could help!

In iTunes go to the Help menu in the upper menu bar. Then click on iTunes Help. Then on Sync your iPod, iPhone or iPad and follow the instructions.
