I have restored my phone to factory settings and took out my sim card how do I know it has erased everything? i am going to be giving it away so I want to be sure this is done right. When I turn on my phone it now asks what language and so Im pretty sure I did it right. Any thoughts??

Then they're gone for good, if they're not in your backup.
This is why is is STRONGLY recommended to use your phone as Apple intends: synch your contacts with a contact manager program on your computer or with a cloud service, and import your photos taken by the iPhone to your computer as soon as possible.

If a phone is sold from one friend to another and wants to use it on a different carrier the friend can contact the carrier it was sold by to request it unlocked. I know AT&T, Verizon, and Sprint will give you the steps to unlock it as long as the original contract it was bought under has been completed. eBay/Craigslist is really not the best place to try to get "unlocked phones" from, if it turns out the phone isn't unlocked then I'm really sorry you got stuck with that one and as stevejobsfan said above I would report them immediately and see if you can recover your money. Either your antivirus/firewall is blocking access to gs.apple.com, your iphone is jailbroken, or your computer was used at some time in the past to hack or jailbreak this or some other iOS device. The first you can fix by disabling your security software. The 2nd you can't do anything about, and the 3rd you fix by editing your hosts file and removing the lines containing gs.apple.com.

Here's a blip from the IOS Message support site:
On iPhone, if iMessage is unavailable, the message may be sent as SMS or MMS, depending on content. Carrier messaging rates may apply. You can adjust this behavior in iPhone at Settings > Messages > Send As SMS. Messages sent using iMessage appear in a light blue bubble, while messages sent using SMS or MMS appear in a green bubble.

It is NOT a bug. You provided a password. If you can't remember it, you can't restore your phone from backup. Very simple.

If you don't know the passcode but have synced with iTunes before while the passcode was set on it, you can back it up then restore it in iTunes on the last computer it was synced with.
If you haven't synced it while the passcode was set on it, or if you don't have access to the last computer it was synced with, you'll have to force it into recovery mode and restore it as explained here: http://support.apple.com/kb/ht1808. Then restore to an existing backup if you have one; if not, you'll have to restore it as a new iPhone and start over.

Oh goodness,SLEEPER888. We wish you didn't have this problem while trying to complete this update.You have done quite a bit of troubleshooting on your own. If the phone update does not take, we would need to replace it with the warranty. Is it still locked up?
