Unless it's covered by insurance, you'll need to buy another at the normal price. Neither the limited warranty nor AppleCare+ covers that.

Unfortunately most warranties do NOT cover theft.
However, take this as a lesson. Next time make sure to set-up Find My iPhone through iCloud.com. I had my iPod stolen once and I was able to track it back and find it easily with that program!

For free from Apple? If you cant locate it with the iCloud "Find my iPhone" feature. Nope. Change all passwords and report it to the police. Give them your Serial Number.

Frankly just about any headset with the proper size connection will likely work. We like ear buds with soft coverings so even when we get a hard headset with a player we swap them out. While Apple might just possibly give you a set for free since they are not an expensive item, loss is not covered by warranty. If you're a long drive from an Apple Store it might cost you more in fuel and vehicle wear and tear than going to a local store and buying a comfortable replacement.

The iphone is not a storage/backup device.
It has always been very basic to always maintain a backup copy of your computer for this very occasion.
Have you failed to do this?
If so, not good, then you can transfer itunes purchases: File>Devices>Transfer Purchases
You may be able to purchase a third partyn program to get the rest ( not supported by Apple)

No. You can turn your 6G Nano in to be recycled at your local Apple Store for a 10% discount towards the purchase of a new one. Otherwise, your only other option would be to sell the iPod on Craigslist or eBay and use the proceeds from the sale towards the purchase of the new 7G nano.

AIf the iPod broke because of a defect then yes, Apple will replace the iPod if it is within the warranty period. A broken/cracked screen is not covered. Apple care does not cover theft. It covers manufacturing defects for warranty. You need to contact the police and report it to them. Only insurance would replace a phone, and usually with a deductible. There is no free phone in your future.
