I'm trying to download apps for my ipod touch.

as it says above, i have been trying to download apps for my new ipod touch but all that keeps happening is it saying the following
update required this app requires iOS4.3. or higher like iOS 5
anyone help or should i go back to the shop and exchange it.
it has the updated software but its not doing anything else.

It looks like you have a 1G iPod Touch running iOS 3.1.3, which is the latest version of iOS that is compatible with that model.  If if it's actually a 2G iPod Touch, you should be able to update it to iOS 4.2.1 at most.
Either way though, if the App requires a high version of iOS than what is possible on your iPod Touch, then I'm afraid you are out of luck.

    If you have a first generation (sometimes referred to as just an iPod touch) or a 2G iPOd, then no. To identify yur iPod see:

    a 1G can only go t 3.1.3 and a 2G to 4.2.1

    ALL of your music should be on your computer in itunes.  Is it not?
    How did it get on your ipod in the first place if not from your comptuer?
    Everything on your ipod should be on your computer and you should be syncing regularly.

    No. If it states designed for both iPad and iPhone, then it won't run on an iPod touch.

    You first have to download the non-compatible version on your computer. Then when you try to purchase the version on your iPod you will be offered a compatible version if one exists.

    Download the apps on your syncing computer and then sync to the iPod. Note that you can only sync apps for the one syncing computer you use with the iPod. You can manage music and videos among different computer.

    You normally need to provide some sort of payment method (in part as proof of residence in the country) before you can get even the free apps. It is possible to set up a new iTunes Store account just for free apps, but you have to create a new Apple ID; you cannot use an existing one. If you want to do that, take a look here:

    Read the steps carefully as the order in which you follow them is  critical. Note again that you can do this only when creating a new Apple ID. You cannot use an existing ID. 
    You will of course not be able to get anything other than the free content without entering in some sort of payment method (credit card, prepaid iTunes card, gift certificate, etc.)

    Unless you initially setup the account without a credit card, Apple requires a valid payment method even for free apps. You can:

    What iOS is curently on your iPod (Setting>Genral>About>Version) you need as lest 2.0 for apps but most apps need 3.0 or later.
