If I don't have apple care, and I bought my iPhone off somebody else, would Apple still replace my iPhone 5? my lock button and home button have been glitching

my phone has been working fabulously and I bought it off somebody else in next to new condition. however, lately the phone button and lock button haven't been working properly. the phone also heats up and gets quite hot when it's charging sometimes. would Apple replace my phone for free ?

If it is still under warranty and the issue is the result of manufacturer defect, Apple will replace it at no cost.
If the device is not under warranty or the issue is the result of damage, Apple will offer and Out of Warranty Replacement.
Warranty has nothing to do with the person presenting the device, it is entirely determined by the device.  Warranty is 1 year from the date of original sale.
