I suspect that you are saying that you can't download/install the latest version of iTunes.
All I can say is try removing and reinstalling the Apple software using the following:
Removing and reinstalling iTunes, QuickTime, and other software components for Windows Vista or Windows 7
If you have further problems with installing Itunes I suggest you post in the iTunes forum since you have an iTunes problem, not an iPod problem. Also report the wording of any error messages. What they say is importent on resolving them.

The OS really is the only different thing.
An iPod Touch 4th generation will still be an iPod Touch 4th generation no matter what OS you have running on it.

You also don't need to return the product if you want the latest OS. You can do it yourself through iTunes.

I bought a white iPod touch and a case for the 4th gen iPod touch at the Apple Store thinking it would fit because it is really a 4th gen right? I never had a 4th gen (had 3rd gen) so I'm not sure if it's new but is the power button moved down or something along the back for 4th gen? Are you sure there are actual differences between this year's and last year's 4g iPod? Maybe the case you go is not really right. The following lists the dimension of the iDevices so that manufacturers can design cases. It only has one drawing for the 4G iPod. It does include a drawing for the iPhone 4s.

It may be the encryption method your router is using. I know that an iPod will not connect to a router that is using simple WEP encryption. Make sure you are using some form of WPA.

First of all, as a rule you should have two backups before you do anything else. (most don't, and it's up to you).
I would have one backup done as a Time Machine backup on an external disk, which you will use to import all settings, data and apps to your new MBA via Setup Assistant on your very first boot of the new machine.
Second, I would have prepared, a bootable backup done via Carbon Copy Cloner or Super Duper on a second external disk. This you can use for unforseen problems that might be evident on the Time Machine backup (hey it happens).
After you have these two items in preparation, then use the original system disk or flash drive to reformat and reinstall the original operating system to the old machine, cleanly. After that, it is ready for sale. If the unit is not an SSD equipped MBA, you can perform a secure wiping of the disk when you perform the reformatting.
To reiterate.... You need a good Time Machine Backup as a source for you setting up the new Mac with Setup Assistant.

I have a 4th gen and am turning it in to Square Trade one of the best warranties in the business 3 years!
I never updated to that crappy 11 version of iTunes on my MacBook Pro
But let me tell you Square Trade will replace the whole **** thing with a refund
I'm currently on Cover Flow 10,7 on the Mac
Mac is the top of the line a (June 2012) 2.7 I7 quad core, with 512 solid state drive and anti-glare sreen (Non- Retina Model)
I didn't dig when Apple removed the DVD/CD player so I says a definitely NO!, and proceeded to go along with the very top spec. (non-retina) very expensive even thought it was not the Retina model.
So No! I don't have have the Retina Model but I do have the very highest spec. md 2012 model.
Hesitated updating to iTunes 11 and glad I never had to pull out my hair by downgrading like the rest of these guys
So I'm experiencing some defects on my iPod Touch it's almost 3 years old and have the Square Trade warranty a lot better then Apple's and just wanted to know if the new iPod Toucn 5 came with Cover Flow on it because I won't update to that new crap. That's exactly what we want 10.7 Cover Flow. Never Update from 10.7

Im glad you like the new iPod Touch. I also got the new iPod Touch 4G (32GB). It is a nice upgrade from the 2nd generation lacking some major features such as multitasking and home screen wallpaper.
