- I you had turn on the FindMyiPod feature than you can go to icloud.com, log in and go to FindMyiPhone you may be able to locate it if wifi is on. However, that can be disabled by turning it off or restoring the iPod
- Otherwise, just the old fashiponed way. Apple will not help

First of all, look in the garbage. It's easy to move a folder there without knowing it.
Second, do a Spotlight Search (Cmd-Space), and search for a file you know should be there. If you find the file, there's a good chance that the other files you're looking for are there, too.
If you're in kind of a crisis mode, coming up with pat advice probably isn't a good policy - but I suggest investing in a backup drive in case anything goes wrong. A program like Time Machine can be a life saver.

Unfortunately, the only thing you can do is filing a police report. Apple does not have any sort of process for recovering lost or stolen machines:

If you were running Lion and had activated Find My Mac you can log in and see if you can track it down. Find My Mac only works is the machine is on and has an internet connection. The odds of a thief having the machine on at the time you try to track it are pretty slim.

The easiest way to find your serial number is this Open Itunes...click help... run diagnostics.....(tick or untick as necessary) so that you just have ticked the last two, device connectivity and device sync. run these tests. it will say no ipod/ipad found but will give results of test....scroll down to bottom of results... here you will find the serial number of your last attached devices.

First, report the theft to the Police, do not attempt to recover it yourself.
Second, if you turned on Settings > iCloud > Find My then login to your iCloud account, click Find My Phone and IF the iPad is turned on and connected to the internet it will show its location. Give that information to the Police.
Apple does not get involved in location of stolen or lost property.

Find my iPhone is relatively useless when it comes to recovering a stolen device. Anyone with a bit of know how can defeat it in a matter of minutes. It's really meant to help a person find a misplaced device.
Presume that any and all data and info on that device is compromised, do as Illass says, change any and all passwords to every account or site you accessed on the device and write it off as gone.

Use either the Alt or F10 keys to temporarily display the menu. Then in the View menu select Toolbars, then "Menu Bar" to make it permanently display the menu.

Apple is not law enforcement or a private investigator.
If you enabled the "Find My iPhone" feature prior to the device being lost/stolen, you may be able to track it via iCloud.com.
If you did not enable this feature, there is nothing that can be done.
Contact your carrier and law enforcement.
