IOS 7: When I go to settings general software update it says its up to date at iOS 6.1.3

So when I hit settings on my iPad Mini, then general, then software update, it says its up to date on iOS 6.1.3
When I hit setting on my iPhone 4S, then general, then software update, it just gets stuck on checking for update.
Anyone know what the problem is? I'm guessing Apple took down the update servers to fix them because of the overload of users trying to download it..but I just want to double check.

    Updating from the ipod itself is a feature of ios 5 or later.
    You would need to update as always.  Turn on computer, open itunes, connect ipod.
    The first gen ipod will only go to 3.1.3

    Go to Settings > General > About and see what iOS version you are running.  If it is lower than 5, you won't find the software update button.  It was added when iOS 5 came out.  The current iOS is 5.1.1.  To update to the current OS, you'll need to connect to the computer you sync with (this is important - do not connect to a computer you do not sync with as you will lose you apps) and update the software in iTunes.  Once you have updated to the 5.1.1, the software update button will be in Settings going forward.  Make sure you have a lot of time.  Updating from below 5 to 5 or higher is a somewhat lengthy process.

    I have exactly the same problem.  iPhone 4S, never been jailbroken.  Not behind a firewall and it happens whether I am on my home compute (iTunes) or directly thru Settings_Update.
    Looks like loads of people are having the same problem - and as far as I can see, Apple's sole reply is jailbreak or behind firewall/ security settings/anti-virus.  None of those apply here!

    If you have an iPad 1, the max iOS is 5.1.1. For newer iPads, the current iOS is 6.0.1. For the iPad Mini the iOS is 6.0.2. The Settings>General>Software Update only appears if you have iOS 5.0 or higher currently installed.

    No. It doesn't. That is only present if you are already running iOS 5 or higher.
    Since the iPhone 3G can NOT run anything higher than 4.2.1, you will never see it on that phone.
