IPhone 3G Warranty question

I live in Luxembourg, I bought a brand new german iPhone 3G without T-Mobile contract on eBay (in its original packaging, never touched)(I didn't know at the time that it had a SIM-Lock), and just after unpacking, the mute switch broke off. Now, to get proper online help, you need a serial number of an activated phone, which I can't supply, since the iPhone hasn't even been activated yet (because of the SIM lock, it'll only accept T-Mobile SIM cards), and it's already defectous.
Apple Premium Resellers won't touch it, because normally, it's the contractor's job to send defectous iPhones to Apple (or at least I've been told by them), T-Mobile won't touch it, since they had that huge privacy scandal just a while ago and can't risk anything right now, and since the phone hasn't yet been activated, the Luxembourgish contractor won't touch it, since it's a T-Mobile iPhone.
I've been pushed around quite a bit now from Apple reps, T-Mobile reps, service hotline people, and Vox (luxembourgish service provider) reps, and I KNOW my rights. One (1) year warranty in case of defectous hardware, except if it's become defectous as a consequence of misuse, abuse, flood, earthquake, fire, or other natural forces. The phone has been used in the margin of what could be called "normal use" (in fact, it's never been used, so that margin is still quite big)
Nobody seems to be responsible for sending the broken device to Apple for repair services, even thought the device is, clearly, still under warranty.
I don't want to have to pay up to 200€ just because I had the bad luck of getting that one particular bad mute switch.
My questions are: who can I go to? Where can I send my iPhone for repairs? why hasn't Apple accepted it in the first place?
Has anybody made any similar experiences, or does anyone have any helpful advice for me?

I already tried activating the phone with a prepaid card, but T-Mobile phones seem to only accept contract cards...
So there is such a directive/law? As for the limitations: the phone was bought originally from an authorized retailer, it's not like I have an illegal stolen phone or something, but shouldn't it matter if I am not the original owner if the phone wasn't even unpacked, right? (at least I hope it doesn't)
I mean, if I bought a Macbook, and a week later, I'd sell it on eBay, the warranty would still be valid, so what's so different with iPhones? It's an Apple product I paid for, it's less than a year old, it broke under (less than) normal use, why isn't anybody responsible for fixing it?
apart form that, I'm not trying to force a retailer from Luxembourg to fix it, that's why I went to Germany to a T-Mobile shop and called the German Apple service hotline (Who accused me of being a hacker, by the way. On the phone. After a 10 minute wait. Yeah, I sure ain't calling that hotline anymore)... but that didn't turn out anything helpful at all...
What I could try is getting a cheap T-Mobile contract without cost unless I call somebody (you know, basically like a contract that acts like a prepaid card, I hope such a thing exists), activate the phone, drive back to Trier, and get it into repair under the warranty.
and even if al else fails, I guess I could still just google for third party repair services (although I want to avoid such things, as that would void the warranty)

    The person bought the iphone exactly on April 25 2012, that means he sold you the phone while still being under warranty. It is possible that the device is stolen ans Lawrence said because usually people dont buy a 4S and sell it that quickly.
    I suggest checking with your carrier to ensure that this device is not stolen before using it

    1. Probably. Your carrier will likely charge you nroaming charges.  If you mean can you use it with a U.S. carrier, then that depends on whether your iPhone is locked to a carrier or not.
    2. The iPhone warranty is only valid in the country of purchase. If you did not buy the iPhone in the U.S. Then the warranty is not valid in the U.S.
    3. No, no such thing as international Warranty on iPhones. Warranty is only valid in the country of purchase.

    Icloud or itunes backup, only backs up app data, not the app itself.
    so if you restore as new, then there is no app data on your phone, you start out new...

    Bcoz im having the problem regarding the network service. My phone shows No Service and keep on searching for network. Before, i use 'android' phone and theres no issue on coverage problem at the same place. Compare to the other iphone, theres no problem with the same network which shows 2 or 3 bars. Will i get 1 to 1 exchage for the warranty just because of that problem? Apple, please help me coz its the first time im using ios phone.

    Not typically.  The iphone warranty is generally only good in the country of original purchase.

The store manager specifically told me then that the product came with a global warranty coverage.     The warranty is not international. You'll have to return the phone to the US and have someone take the phone in to be serviced.

    you cannot downgrade the iOS at all.

    Support and warranty coverage is honored in the country where the iPhone is sold officially by Apple only.

The low price for the extended warranty is charged directly to your Verizon Wireless bill each month. 
    My headphone socket does not work properly.  When the headphones are in the socket, it does not hold it in there.  I can still listen to music, but I have to be careful that I don't tug on the cord or else it will easily come off. The charging socket also is having problems.  Sometimes it will not hold a charge.  These problems happened because (i'm assuming) I dropped it in water a few months ago. 
    Another problem:  Sometimes when I'm on Safari (or Mercury browser),  it's loading a page then suddenly it stops and it closes down and shows me the homepage. 
    Am I able to get a replacement iPhone 4 under my current warranty because of the problems I am having?

    No, you cannot. The phone was dropped in water, which makes the warranty void. My suggestion is to buy a phone from eBay or another 3rd party, see if you can upgrade, or utilize Verizons CPO program, but currently there are no iPhones in that program.

  • IPhone 5 Dead Pixel Warranty Question?

    Hey guys! So I have an iPhone 5 with a bunch of dead pixels/dust sort of near the top.... My situation is somewhat unique, so I wanted to see what you guys thought! This iPhone 5 was in warranty just couple of months ago, where they replaced the screen glass. Now that these dead pixels/dust are on the screen (probably due to the 'repair' as they weren't there prior.) will they still cover it since it was something they caused right at the end of my 1 year warranty? Obviously I can create an appointment and find out, which I probably will, but I wanted to see if anyone had some insight on this! I don't want to make a trip just to find out they will do nothing for me....

    Obviously you didn't read what I said. And if what you have to say doesn't matter then don't say it. Let me say it again for you, since you obviously failed to read it the first time. I don't want to make the extra trip if it isn't needed, I was looking to see if others have experienced this issue and what were the outcomes of them to avoid going to the Apple store and having a bad outcome. Not eveyone lives right next to an Apple store.
