Iphone 5 Battery not under warranty in yr 1?

Has anyone had their battery tested? Mine is right on the verge of "red" but still in the yellow. I use my phone no more than I had my Iphone, 3, 3s, 4, 4s, yet after about 7 months Apple says it has been used too much.
I also have had 2 cables go bad with my Iphone 5. I have never had either of these issues with my past Iphone's.
Has anyone had luck not paying the 79.00 to get the battery replaced? I guess I feel this is the first time Apple has let me down and if the phone can name make one year of use (I get the new ones every year) that it may be time to look at comparable models.
I really enjoy all my apple products at home and my phones. The phone integrates well with the rest of my apple products and the service has always been superb. The lady actually told me I need to take better care of my things. I have an Iphone with only a bumper in perfect condition, I also know I am not the only one that has had issues with the cable.
So what is the answer to a phone that can not make it through a year without issues and has anyone had luck reasoning with apple? I also raised the concern that the bad cable being intermittant may have degraded the battery as well?

check a few areas.  Check your mail accounts in settings.  Check to see how often it is fetching data (email).  The more often it checks, the more battery it uses.  Also, if you're not using wifi or bluetooth, turn them off.  Check your settings in stuff like facebook, twitter, etc.  These often check for status changes every few minutes.  I'd set them to where they only check for updates when you open the actual app.  Also, in the Siri settings, turn off "raise to talk."  This seems to use battery.  Last thing, check your location services.  If you have a lot of apps that are constantly checking where you are...that's using a LOT of battery.

The service battery indicator appeared shortly after updating to 10.6.something - I'm not sure what, I just know it had been a while since updating. If I take this into Apple is there any chance of them covering replacing it or am I SOL on this one?

    Yes, that's correct, prepare to pay.  For instance, let's say you bought some new Pirellis (those are tires) for your Lamborghini, and the guy at the tire store told you that you would get 15,000 miles on them (these are for your Lamborghini, so they won't last 30,000 miles like some tires do).  So you head on out with your Lamborghini, and within 10,000 miles all four tires have lost their tread, three of them having blown at various times on the freeway.  But hey, it's your fault, I'm sure it has nothing to do with the tires.  Just like with your battery.  I don't think you should be thinking your Mac is giving you bad information or charging your battery incorrectly, based solely on the fact that about TEN THOUSAND other Mac users have noticed the same issue.  It's undoubtedly that your battery wore out, even though Apple says those batteries last (at a minimum) 300 cycles.  Or the fact that users have done a battery reset with PRAM and SMC reset, and had their batteries start to fully recharge again.  I wouldn't rely on that.  I would instead rely on people who reply with an absolutely worthless comment, as if they actually worked at the Apple Store. But hey, that's just my opinion - I'm sure a lot of people think Snow Leopard has been FLAWLESS, with no issues whatsoever.  In fact, I would say that for a BETA release, Snow Leopard hasn't been bad at all (wait, it's not a beta release, you say?  Hmmm....).

    Reset both devices ...
    Press and hold the Sleep/Wake button and the Home button together for at least ten seconds, until the Apple logo appears.
    If that doesn't help, tap Settings > General > Reset > Reset All Settings
    No data is lost due to a reset.

    The warranty will apply to the country of purchase. And if there is a problem needing repair you have to return it to the country of purchase.

    I'll let you in on a bit of a secret.  Apple retail staff (Specialists, Geniui and Floor Mangers) have a great deal of leeway when it comes to customer appeasement.  When rapport breaks down, the customer is less likely to enjoy that leeway.  Chances are, no matter who made the intial call, it will be reinforced regardless of how high it goes up the supervisory chain.
    The item you went in for retails for $19.  They probably misplace four or five of them each day.  If they sent you home without one, there was likely a good reason for that.

    This iPod is not under warranty anymore, unfortunately, but I've noticed that it has had a few problems since I got it, but it was never this bad until just recently. The iPod touch screen will not respond to touch in a vertical row  on the left side of the screen, and horizontal in random area of the bottom screen, which is hindering me from typing or playing apps and even scrolling through my music. This device has never been jailbroken, had waterdamage, or anything (it's also running the latest hardware).The iPod used to do this, but I'd reset it several times and it'd be fine, but just recently it won't fix anymore. Also, sometimes if I unlock it (which takes multiple tries since not of that row works) and leave it there, it will starts doing it's own thing and opening random apps and such. I'm thinking of taking it to the apple store (the only reason I haven't is because of many bad reviews online for that store), but I'm afraid they are going to want to charge me for half of what I paid for it. Any suggestions? It would be greatly appreciated. Thank you.

    Yes, but you should consider this.
    A: Laptops usually last only about 4 years.
    So if you take your investment into the machine + add any software that can't be transferred to a new machine and divide that by 4, you'll get the per year value.
    Take that and estimate how many years of value you have left, then judge if the repair is going to be worth getting that remaining few years left or not.
    For instance if you have $2800 invested in a machine, that's $700 a year and it's 3 years old, that means it's likely to have only $700 of value left, so it makes little sense to spend a lot to get that remaining $700. Sell it for parts and apply the funds to a new machine.
    I suspect you upgraded a older machine to 10.7 and it likely killed it.
