IPod Touch 4Gen is having problems.

Question

So as you could see in the head line its an iPod Touch 4g and so Ive had it about 11 months now. Im still in the warranty if your wondering. Now heres what ive experience prepare to read alot.
So the first month I used it it got wonderful battery life with wifi & blutooth on. Birghtness was all the way up and I used it quiet often to text play games netflix blogs etc. Bascilly its my second computer. Ive got around 8-10 hours of battery life when I had it for the first month. But over time the battery slowly holds less charge which I get which im on of those geeks who loves his electronics. I took care of this iPod like it was my CHILD (and no im not married im only a teenager under 18). I never would let my friends use it because well one they might drop it and two loom up **** on it! So its been in my hands only unless my mom took away which ill get to that later.
Second month now it gets about 6-8 hours didnt really notice but i was ok still doing what I do then I got this neat toy from Brookstone. It was the rover 1.0 which was awesome never could stop playing with it casing me to run through so many batteries. During those times the iPod starts to heat up I mean get warm. So I took it to somewhere cold like the fridge and left it in there for about a minute and in no time its cool again. Also I got new speakers blutooth ones there awsome then my parents complain Im now playing my music too loud.
Third month (Ive fast foward a two months because well it was the same thing). Now its January Im having school problems my grades slipped drasticly! (Dont worry I pulled up all my grades I wasnt the ipod fault Im dislisex but I could write very well put together paragraphs). Now report cards came in and my parents saw two F's so I was banned from my xbox and iPod well I lived since I got them back like after 6 months. So during that time my iPod sat in its original casing protected from everything to not damage it.
Fast forwarding six months now. Now its June 14 Ive got my iPod I was so happy again. I recharged it and started doing what I usually do when Im not on my computer. Ive stopped using my blutooth speakers and rover becuase I got board of them after a few months. I learned that having my brightness all the way up is bad for battery life and wifi and blutooth is also bad for battery life. I turned down my brightness to 25% with auto brightness on. Wifi and Bluttoth are only on when I want them on. I forgot this but here it is around November to December I had to keep charging it every night. But ive noticed the battery life is now from 3-4 hours.
Now its July for me and I just came home from summer school. I was inclass when I noticed that I get about 3 hours of battery life. When I mean battery life I mean doing all those stuff constatly especially games like hill climb zombie ville coin dozer yeah you know 2d games that require less power to run. I was wondering since im getting such horrible battry life like sometimes I have to charge my iPod during the day to keep up with my daily life. I was wondering should I take it in to Apple store to get a replacement before my warranty expires. I have about 50 days left or something like to make sure I got this iPod for my Birthday but my mom wouldnt let me use it for a week when I got it. I also fogot to say that my dad bought it off amazon from the Apple store so it was shipped here.
When I bring it in could i just tell them what I told you and recieve a new iPod with out paying some kind of fee because it would be a huge pain in the A** to spend $300 for a new one which I dont have that kind of money for because well guess i could say safely im poor I cant even afford a hundred dollar fixie from target I really want to get it but dont have the money for it right now. If I could bring it in to the store without paying a fee then im head there this Friday that leaves me four days.

Thank you so much yeah sorry about making you read all that but hay I needed someone to know everything about the iPod. Also I just remember I bought this Gorilla screen protector will I have to peal it off or they just replace it for me because I bought this at the mall where they put it on for me. I really don’t want to have to spend more money then I already have since I bought a $30 cassette case it really nice and makes it look like an iPhone. My friends ask me is it iPhone 4 or 4s.
