IPod Touch Lock Code - Is my iPod in danger??

Hi guys, so i set my lock code to 14h and someone stole my iPod. After a while of not using it, the guy who stole my iPod will have to enter the lock code. So is my iPod safe or can he reset the lock code without knowing it?

Have you reported your iPod stolen?
Your lock code keeps your personal data safe from someone picking up (stealing) your iPod. Hopefully you do not have any sensitive info on it. I think he/she can reset the iPod, deleting all your settings and then set it up for him/herself.

I have mine set for 1 minute (which is probably too paranoid) and erase data after 10 failed passcode attempts.

    Do as the manual says to do and restore the ipod.
    If you are unable to restore then type "unable to restore" in the search bar at the top of this page by Support and read the resulting help article.

    Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.

    If you restore from iCloud backup the apps will be automatically downloaded. If you restore from iTunes backup the apps and music have to be in the iTunes library since synced media like apps and music are not included in the backup of the iOS device that iTunes makes.

    As far as I'm aware you're referring to the passcode. It seems that you've forgot the passcode that you've inserted, so your best bet is to connect your iPod to iTunes and have it restored back to factory settings. You'll be able to find the restore button by clicking on your iPod's name that's located right below the "Device's Tab."

    I understand that you want to remove the volume lock on your iPod nano.  Here is a article that will walk you through the prcoess or removing the volume lock.  
    To remove the maximum volume limit:
    If you are currently listening to your iPod, press Pause.
    Select Settings > Volume Limit.
    If you set a combination, enter it by using the Click Wheel to select the numbers and pressing the Center button to confirm them.
    Use the Click Wheel to move to the maximum level on the volume bar to remove any restriction on volume.
    Press the Center button to accept the change.
    Note: If you forget the combination, you can restore iPod.

    If it's showing the disabled screen due to too many incorrect passcode attempts then you will need to connect it to the computer that you normally sync to and you should then be able to reset the iPod and restore/re-sync your content to it (http://support.apple.com/kb/HT1212) - you may need to put the iPod into recovery mode in order to be able to reset it : http://support.apple.com/kb/ht1808
    If you do it via a different computer then :
    If you restore on a different computer that was never synced with the device, you will be able to unlock the device for use and remove the passcode, but your data will not be present.

    Have you tried restoring the iPod via itunes on your computer? First restore from backup and if problem persists restore to factory defaults/new iPod.

    - No directly.  You have to first get the music in your itunes library on your computer and then sync the music to the new computer.
    - You can/should restore you new iPod from the backup of your old iPod to get app date and other things on the new iPod.  You will have to reenter passwords since passwords only get restore to the same device. The backup does not contain music so that has to be synced.
    - You can transfer iTunes purchased from an iPod to your computer by:

    You do not merge libraries.
    iDevices sync to one and only one computer.
    If you want a single library, you manually move the content from one library to another... all content will still be associated with the Apple ID it was acquired with.
