Is it legal to sell Iphone 5 full price and locked ?

I've bought Iphone 5 from Straight Talk. Paid full price at the register and later I've learn that my phone is locked to ST. Is it legal for them to do so? There is no contract and I paid full price. If I knew that I would've bought one from Apple Store, unlocked. After HOURS of talking with ST support, they said, there is nothing they can do, and cannot unlock phone because they do not have ability to do so. And suggested for me to buy a new(!) phone that is unlocked. Unfortunately for me I do not like to be taking advantage of and do not have an extra $700. Plus I do have a new phone. They even called me difficult. I've just wanted an explanation why my phone is locked, or why I was not told about it upfront, before I've bought it. Or why it is a full price then.

The problem is that I was told that it was the official unlock status checker.  When I spoke to Straight Talk the confusion apparently arises that CDMA phones are apparently listed as "locked" even when they are not since they require more steps than GSM phones to allow a hookup to a new carrier.  According to Straight Talk, the reason they do not offer "unlocking" is that ALL of their phones are unlocked (so I can take this phone over to Verizon without any issues).  CDMA phones CAN be locked but Straight Talk says that none of their phones are locked PRECISELY because they offer no-contract.  I just wish that they would make this more explicit so that this confusion would be alleviated.
Once again, however, I was angered by the dismissive attitude by posters on this board. To blame the customer is the height of arrogancy and only causes more bad blood.  It is absolutely NOT the fault of the customer to think that a full price phone OUGHT to be unlocked and it certainly should NEVER be the fault of the customer if she or he has specifically ASKED for an unlocked phone.  Anyone blaming the customer in such cases is simply being a jerk.
I think that this might have been the same issue that BLUEO had. If posters would ask relevant questions and come across with some sympahty to those of us who have legitimate gripes, asking and answering questions in a thoughtful manner, blood pressures could be reduced and everyone could find answers.  It is clear to me now that the problem lies with the fact that unlock status checkers may be incorrectly flagging CDMA phones as "locked" because I note that some people actually THINK that they are locked simply because we do not use SIM cards and thus require access to a computer to reprogram it rather than simply popping a SIM card into it.  Thus, I think the confusion in India that I experienced. It could, apparently, have been used with one of India's CDMA providers but the vendor there probably wasn't used to CDMA since India's CDMA carriers only started operating with iPhones a scant 3 months ago.

  • How do I purchase a IPhone at full price from the Apple Store.

    I have been a Verizon customer for over 10 years, and I currently have the unlimited data plan.  I was informed that if I upgrade my IPhone I would be required to switch to another Data plan (because the unlimited data plan is no longer offered).  I was also informed that if I am willing to pay full price for a new phone, then Verizon will allow me to keep my current plan. 
    If I am going to pay full price for a new phone, I would like to purchase it directly through the Apple Store instead of through Verizon.  Unfortunately, according to Apple, the only phones that I can purchase for full price are unlocked phones and these phones do not work with Verizon plans. 
    Has anyone been successful with purchasing a I-Phone from the Apple store at full price and using Verizon as their service provider?

  • Credit for Purchasing Original iPhone at Full Price?

    I have been out of the country for several months, so I know I'm a little behind here, but was there ever any sort of compensation for those of us who purchased the original iPhone at full price? I heard that there was an iTunes credit or something similar.
    If there is any sort of compensation, could someone point me in the right direction? Thanks so much!

    I 'm not sure where the confusion lies. The 1st gen iPhone has been out for a year. There was a price decrease after the first 3 months, and as a concession to early adopters, there was a rebate/refund of $50 or $100 back to the iPhone purchasers. That offer has now, as mentioned above, expired.
    The 1st gen iPhone was not subsidized by AT&T, so the user paid for the phone up front, and then subsequently the contract charges (including the $20 data plan) each month for the projected 2-year period. Since all 1st gen iPhone owners *by definition* got non-subsidized iPhones, AT&T says we are eligible for the lowest tier pricing. So are current AT&T users who have fulfilled their current contracts that included a subsidized phone.
    The second price tier is for an early upgrade. This from the AT&T site: "You have the option to purchase an early upgrade priced at $399 for 8GB (black) or $499 for 16GB (black or white). Two-year contract required." That's for folks who are still in a contract for a subsidized phone.

    Normally I just take the current special that a cell phone company is offering and lock in for two years.  So far that has worked out fine.  But if I decide to buy a new iPhone at full price, does it work out to be cheaper in the end?

    This depends, are you on an old voice and data plan where the company over charges you from day one to pay for subsidized cell phones.  They you should definately buy a subsidized cell phone.  You are already over paying for service to cover the subsidized phones cost.  If you don't buy a subsidized phone every two years, the overcharge is just more profit for the cellular company.  Be aware they will charge you a $40 activation fee just because they can.
    If you have moved to one of the new voice/data/text plans where you are expected to bring your own device, then buying the phone outright make sense.  Here again, you will be charged the dreaded $40 activation fee.  With AT&T, you can do their NEXT plan and pay for the phone over 20 or 24 months.  And the NEXT plan waives the $40 activation fee.

  • Is it legal to sell photos edited in trial and beta verisons of Photoshop?

    I recently downloaded the new CS6 beta version of photoshop and since I am interested in stock photography I was wondering if it's legal and not againts Adobe's rules to sell photos edited in trial and beta versions of Photoshop? I mean, since you haven't bought them and just trying them out.
    I really haven't found info about it, yet. Adobe terms and policy are little overwhelming

    The last time that I read the EULA, the only restriction on commercial or production work was on beta/pre-release software. So you could use the CS5 trial but not the CS6 beta.

  • New iPhone 4 bought for full price but locked!

    Hi there,
    I have a kinda complicated problem.
    I bought an iPhone 4 in Mexico from a reseller called iShop. They sold me the phone with a prepaid sim card from Telcel. They told me that the sim included 1 month free internet so I decided to use it there as I had another week before returning to Argentina. I activated the iPhone with the sim, but at the store they told me the iPhone was fully unlocked and I could just change to the Argentine sim when i returned.
    So I get back to Argentina and get my new microsim from Personal. Now I have no service and itunes tells me that the sim is incompatible. When I check under settings -> general -> about - it tells me that the carrier is "Telcel 8.3".
    So telcel do NOT offer unlocking. They told me to go back to apple (they gave me a generic response which was targeted to any kind of phone unlock request it seems). I called apple US and explained the problem (I even spoke with a Supervisor) but they told me that there is absolutley nothing I can do, and that the phone is locked to Telcel because I activated it with that sim card first. I thought the whole point, was that I could just change SIMs at will with an unlocked iPhone. I assumed there was some activation process involved but not that it would actually lock the phone. Should I actually do something like wiping the phone and trying again?
    Following from this I'm not sure what else I can do? Now I have a super expensive ipod and if i'd known that activating that sim would lock the phone I never would have used it.
    I read somewhere on the forums that if the store adds the number of the phone to the receipt that is what locks the phone. Is this correct? Is it the fault of the reseller? I'd like to know in case I can take some recourse with them on the problem.

    You were lied to by the reseller, who do not appear to be an authorized vendor for the iPhone in Mexico. Only the Apple Store, Movistar and Telcel are authorized vendors, so unless iShop is an authorized agent for one of the two carriers, you purchased an iPhone whose actual source is unknown. Whether or not iShop is authorized, though, iPhones are not sold unlocked in Mexico and neither Movistar nor Telcel provide unlocking services, so what you were told is untrue.
    Sorry, but there's nothing Apple or any of us (your fellow users) here can do to help in this matter. You will need to contact iShop and take this issue up with them.

    i got a bad verizon phone (samsung intensity) in august 2010. this coming august my two year contract lets me get a new phone for cheaper! ive been saving up for an iphone for 1 year and 5 months now and my plan was to get it for my birthday in september because my two-year contract will be up. BUT if the iphone after the 4S comes out a little bit after that then I will wait (because iwant the newest version, who doesnt) so  does anybody have an idea for when its coming out and the price?! because once i get a phone my mom says i will have to wait for a LONG time to get another one. and i want the iphone SO bad! PLEASE HELP!!!

    Ive decided to bite the bullet and pay full price to keep my unlimited data. Just wondering if I should roll the dice and gamble $600, only to have VZW pull the rug out from under us.

    No chatter. Verizon likely won't announce it until a few months before it happens at best. Chances are they won't do anything until the end of June 2014 when the last people with unlimited still under contract have their contracts run out.

  • IPhone 5 full bars and LTE but no internet (Verizon)

    I have an iPhone5 with Verizon LTE and I get GREAT service all over San Francisco EXCEPT at my garage! I can't understand it, everywhere in the city: at home, at work (in a basement), all over the place I get full LTE service but for some reason in this ONE spot on a residential street two blocks from my house I'm having some problem. It's a garage I rent and in there, I have bars and it says "LTE" but the connection ALWAYS times out. Not just inside the garage, but just outside as well. Location is 23rd at San jose in San Francisco. I even typed the *3001#12345#* to see the exact numbers and they are -84 at the garage but around -100 at home and at work, but I get great service at these places. For some reason in this one spot, it will say I have service, but it can't connect.
    Why does this happen??

    No, I'm really not sure if this is a hardware or carrier issue since the weird thing where it says I have service but the phone won't actually connect to any data.

What I was wondering is can i pay the replacment cost of an Iphone 4s and get that instead . I dont see the problem since my phone is broken anyways .     The only exception would be if there were no like models available.  There was a short period when there were not sufficient supplies of the 3gs to effect warranty replacements.  In that case, they replaced the 3GS with a 4 at no additional charge.  But the warranty fine print specifies that they will repair or replace the device, at their discresion.

    Hi, I have just upgraded by iPhone to the new model. Just set it up but I have problems with email. It seems to upset my email on my normal computer (cannot sign in) and my sub folders in my inbox don't show up on my iPhone.

    Is the account an Exchange, IMAP, or POP account?
    Did you transfer the backup for your previous iPhone to your new iPhone?
    If so, try deleting and manually recreating the email account on your iPhone. If you have Sync Email accounts selected under the Info tab for your iPhone sync preferences with iTunes, deselect this followed by selecting Apply before deleting and manually recreating the account on your iPhone and leave this deselected under the Info tab for your iPhone sync preferences with iTunes.

  • MacBook Pro and iPhone both remotely wiped and locked not by me

    Hi all!
    So this is kind of a complicated situation I guess since Apple support couldn't help.
    Last night while I was sleeping at around 5:30 A.M. I received 2 email confirmations from apple saying that I had successfully wiped both my iPhone and my Macbook. The devices worked fine until around 930 then the iPhone restarted to a new iOS5 welcoming with all my stuff gone. No problem though I just restored through iCloud. My MacBook on the other hand will not boot into the normal OS. It goes into a utilities mode with no accessible options other than a message saying "Enter your system lock PIN code to unlock this mac." along with a message from who unlocked it which says "Bilker!" I have no idea what this means or who could of done it as no one knows my iCloud login credentials, other than a potential hacker. Even if I try to reinstall the OS by booting and holding command+R it requests this PIN. If I try to boot from a disk drive it will do the same so I am at kind of a loss of what I should do.
    Any suggestions or help would be greatly appreciated!

    First, back up your HD, to save the items on your computer.
    Second, visit your local Apple Store/Genius Bar. They have access to tools that should be able to fix your system problem. Bring your install disks. I believe they will ask you to clean install your HD.
    Third, and almost as important, share the results on this thread. I'm certain that other users will gain knowledge from this incident.
