Is my iPhone 4 replacement a reconditioned phone?

Apple have replaced my iPhone 4 with another one because of a fault (screeching noise at the beginning of around 20% of incoming and outgoing calls).
I'm worried that the replacement is a reconditioned phone, as Apple Care told me that there was no guarantee that it wouldn't be. The replacement was delivered in a different box (with no accessories), although Apple Care have told me (based on the serial number) that it was manufactured on 3rd July and they despatched it to me on 26th July.
I know that there will be very few reconditioned iPhone 4s in circulation so far, but I don't want to be one of the unlucky few to receive one. I am very unlucky with faulty goods and I therefore avoid anything that is not brand new. How can I be 100% sure that it's not reconditioned?

There's nothing further anyone here can say. Apple's policy, as is the case for virtually all manufacturers of small consumer electronics, is that they can replace a defective iPhone with new or reconditioned units at their option. Nothing I can find in says that this policy is in any way against UK consumer law. So there is no way that you can be guaranteed that a replacement phone will be new stock, though this early in the release cycle it's likely.
If you wish to debate with Apple about this, you (or your attorney) can do so by calling Apple Customer Relations. But there's no point in arguing about it further in these forums. There's nothing any of we your fellow users can do about the situation and Apple does not reply to posts here.

    So, have you tried a reset?  Restore from backup? Restore as new?  You seem to have a few problems but do not mention any action taken to resolve them.  What have screen protectors to do with anything?

    To replace your phone's screen costs $109US and I don't see why having Apple replace the screen would void your warranty.

    Replace the phone with a brand new phone.

    There should be no way to tell.  The dealer/store shouldn't know either.  It should be good as new.
    The warranty clearly states that it can be a refurb unit.  You have no say in the matter.

    If you are in India, contact your local service center for a price quote. I don't know if Indian service centers can replace just the back glass or if they will need to replace the entire iPhone. To locate a service center, see:

    If you are trying to restore to an iCloud backup, this has to be done during the initial setup process.  If your phone is already set up, you will have to go back to Settings>General>Reset and tap Erase All Content & Settings, then go back through the setup screens again and when given the option, choose Restore from iCloud Backup (see image below).  Be sure your phone is connected to wifi and your charger as this will take some time to complete.
    Also, your replacement phone must be running the same iOS version or higher to restore to your backup.  If you are running an older version of iOS than the device that was backed up, your backup will not be visible when you choose to restore to your iCloud backup.  If this is the case, you'll have to update your replacement phone first.

    If you purchased your iPhone from Apple within the last 14 days then you can return it to switch it for another color if you wish.
    If you purchased it through your carrier, then you will need to look at their returns policy, but I expect it would be similar.

    I was hesitant to purchase this protection plan at first about $70, but the customer service agent reassured me that there were no deductables and thats why I bought into it. But now that I look around on the support site, I see that it says that there are up to two incidents covered for a service fee of $49. Did I really get duped?

    If the issue is a manufacturing defect, there is no cost to have the device replaced.
    If the issue is a result of user damage (like a cracked screen) and you have AppleCare+ Apple will replace the device for the minimal fee of $49.  They will do this up to two times during the timeframe of the protection plan.
    If the issue is the result of user damage and you do not have AppleCare+ then the Out of Warranty replacement cost is $199 for the 4S.
    No, you were not duped, you were simply not completely informed.  Whether that was a result of them not sharing all the information or you only hearing what you wanted, no one here knows.

    Keep powering your phone off and back on, it can take up to 2 hours for a normal service provider to finalize the activation process.  When you got your new iPhone (congrats by the way) you should have received a little bubble that appeared that told you when the phone was activated, did you see that?

    Recently, I got my iPhone 5 replaced due to a hairline crack on the back where the aluminum meets the white part of the phone.  When I met with the genius, they replaced my phone with another iPhone 5 that came from a slim white box (with no accessories).  My question is, are these phones "new" or are they "refurbished"? I understand that it has not even been a week since launch day which is why I am assuming there is no such thing as a refurbished iPhone.  However, I was reading in another forum where they said that replacement phones could have 'faulty' products within them that were fixed? It also mentioned that replacement phone had a model number that started with 'N' as opposed to 'M' ... do you think it makes a difference? My guess would be that these letters just distinguish which phone came with accesories or what not. 
    I also checked the production week day on my replacement phone (on the chipmunk website) - and it stated that my phone was still produced before launch day. 
    My sister went to get her phone replaced and they gave her a new iPhone brand new in the box... strange?
    Any input would be greatly appreciated... I mean I'm sure my 'replacement phone' is new... as it has not even been a week since launch day... no way that refurbished phones would be available already?

    We have no way of knowing. It could be either. I would guess that this soon after intial launch that any replacement iPhone 5 would be new, not a refurbished unit, there not being sufficient time for any stock of refurbished units to be built up, but that's stricly a guess. Apple may well have packaged up new iPhone 5s without accessories to be used as replacement units. Again, no one here will know, nor is there any way I know of to tell by looking.

    Connect your new phone to your computer using the USB cable and it should appear in iTunes. If it doesn't you will need to troubleshoot. Then see: http://support.apple.com/kb/ht2109

    It is entirely possible that the human you spoke with at Apple simply made a mistake.  You do realize that humans make mistakes, correct?
    Take the device back to the store along with any documents you have stating it is or is supposed to be unlocked and let them clear it up.
    This all assumes the device was unlocked by the carrier and not some shady website or local electronics store.
