LG Spectrum phone software issue, called in, now cracked screen. What to do?

In March of this year, I used our line upgrade to get the LG Spectrum smartphone. The interface is horrible but for the most part its a decent phone. Until my call quality started going severely down the drain. Even worse, the messaging system installed on the phone began to freeze and require me to force quit, sometimes even turn off and on my phone.
I called Verizon tech support about a week ago and the man who helped took me through a factory reset of the phone. He told me to give the phone a couple of days to see if the problem persisted and if so to call back and ill be sent a refurbished replacement for free. Well behold, 3 days later, messaging lags out again and call quality is still horrible.
Fine, id really rather pay a little bit of money to get a different device but a phone is vital for my job and home life. I recalled Tech Support, told them the story of calling before and already resetting. And now the problem. My 8 year old brother got a hold of the phone and now the screen is cracked. And when I called a second time the lady had said the phone must be free of cracks or the account would be charged 300 dollars. This happens AFTER i called in for a reason with hardware/software!
What do I do not, I am not going to pay 300 dollars again for the same phone that has these problems.

Your choices would be to buy a different phone at full retail from Verizon since I assume you are not eligible for a discounted upgrade, reactivate the phone you had prior to this one, get an old unused phone from a friend and activate it on your line, or purchase one off eBay or similar website.
