Not remotely. Only if yo recover the iPod
- If you previously turned on FIndMyiPod on the iPod in Settings>iCloud and wifi is on and connected go to iCloud: Find My iPhone, sign in and go to FIndMyiPhone. If the iPod has been restored it will never show up.
- You can also wipe/erase the iPod and have the iPod play a sound via iCloud.
- If not shown, then you will have to use the old fashioned way, like if you lost a wallet or purse.
- Change the passwords for all accounts used on the iPod and report to police
- There is no way to prevent someone from restoring the iPod (it erases it) using it.
- Apple will do nothing without a court order

You have a few options...
1. Hopefully you have done a backup in iTunes which would have stored your contacts
2. Check the email account that you had on the iPhone. For instance with Gmail there is a Sync Contacts option on the iPhone which if turned on, would have sent your contacts from your phone to the contacts in your Gmail, so check your email from a computer to see if they are there.
3. Only other option I can think of is if you have an old phone with contacts still on it.

Unfortunately not, you can only try to locate it if Find My iPad was enabled on it and the iPad is currently connected to a network and the device hasn't already been wiped and/or Find My iPad disabled on it.
If it was stolen then you should report it to the police, and if it was a cellular model you should also contact your carrier. You should also change your iTunes account password, your email account passwords, and any passwords that you'd stored on websites/emails/notes etc.

Not by serial number but if recover the iPod, install the Find My iPod touch app.

Update how? Via wifi (Settings>General>Software Update) or vi iTunes?
What photos? Those in camera Roll album or other albums?
Updating via wifi will not delete anything unless there is a glitch. Glitches do happen sometimes.
If you update via iTunes, all your synced media like apps, music, synced photos have to be in your iTunes library (computer for synced photos) since synced media is not included in the iPod backup that iTunes makes as the first step of the backup.

You will need to restore your iPod from the same computer that you most recently synced to.

If it is passcode protected, then it is very unlikely that anyone woul both have the knowledge and take the time to try and break the code.
They would very likely restore teh ipod and use it as their own.

you cannot recover those photos if you didn't perform a backup of the iPhone 4

Your documents were synched with iCloud when you logged in with your AppleID. If you had a photostream before, you could access some photos using the stream.
