    Your only chance is setting it up as new device without using the latest backup afterwards, which you already did.

    I have a passcode for my iPhone, but I don't have the application Find my iPhone. Can I retrieve my photos, notes, reminders and all other data in my iPhone, I mean, if I bought another one, and connect it to my computer and go to iTunes then restore backup, cause I backup my iPhone last Oct 10, 2013, will I recover all the details in my iPhone that was stolen? It's like I'm still using my old iPhone's apps but with a new iPhone. Thanks.

    If you do not have Find my iPhone enabled via iCloud there is nothing you can do. Contact the police; your carrier in case they offer blacklisting and change all of your passwords.

    You cannot lock it by the serial number. Report it to your carrier and the police. You said that the thief knows your pass code. Does that mean that the thief was a personal friend who would be close enough to you to know what your code was? If that is the case, ask your friend to return your phone.

    If you signed up for Find my iPhone you should be able to track it, unless the thief has turned the phone off or removed the SIM card. Also, if the thief has restored the phone it will no longer work. Log into www.iCloud.com and see if you can see the device. If not, then there is nothing you can do but notify the police and change all of the passwords on things you had on the device. Sorry for your loss.

    If you did not set up Find My iPhone, then only your cell carrier would have the possibility of tracking your iPhone, if they offer such as service. Some carriers do, but most require you to sign up for the service and pay extra. You can call your carrier and ask if they have any tracking service available to you.
    If your carrier does not offer such a service and you did not set up Find My iPhone, then there is no way to track the unit. Contact the police and change any passwords for any online accounts you may have used from your iPhone (the iTunes Store, for instance).

    Once again, the Find My iPhone app has no effect on this.
    Find My iPhone must be enabled with your iCloud account settings on the iPhone.
    Location Services must be enabled.
    The iPhone must be connected to the internet via an available wi-fi network or via the carrier's cellular network.
    If the iPhone is powered off, none of the Find My iPhone features can work, and the same if the thief or whoever has access to the iPhone has restored the iPhone with iTunes as a new iPhone on another computer.

    Thank you for your reply, I checked the status of my apple id and nothing has changed. My iphone was off when it got stolen and short after I sent remote lock by find my iphone. Maybe somebody connected to itunes and tried to do a set up using his own apple id? I would like to understand what's goin on and if this apple id can lead us to the thieve!
