That they won't be able to unlock the phone to use it. The phone was only 2 days old as my son had only just upgraded :(

    All you may infer is the device hasn't been turned on where it can connect to Wi-Fi.
    The phone may be jailbroken if there is no lock passcode to prevent access. However, the phone can be completely erased and restored as new. In this case you will have no ability to locate it or prevent it from being jailbroken.

    I had brought a new iPhone so I now wanted 'find my iPhone' to find my new phone not the old iPod.  So when it said erase I thought it was going to erase iPod details not ALL stuff on the phone!!!   It may seem obvious to some but if your not IT expert you just bumble along!!  Apple should make it much clearer for those of us who are 'thick!'!!.  I feel so stupid!!!!!!!!!!!!!   Anyway I now have an empty iPod with all my details on that now I wont be able to transfer to my new phone - so peeed off by this!

    No. It must be active on your device, and you must have registered it with Find My Phone service from Apple.

    Thanks for the help.....yes! have downloaded the ios8.1.1, and also using the wall power adaptor that came with the Ipad. I'm sure now if the problem is with the device or with the adaptor. Although when charging it shows the lightening sign next to the battery symbol but the % doesn't really move. I've also tried turning off the device and charging but that hasn't made too much of a difference....for instance its been charging for three hours now and it only gone up 1%. This though has only been evident today. Is there anyway of testing or any diagnosis app which can be use to test if its the adaptor thats the problem or the device???

    i can probably answer this part for you. in our bills and laws the privacy act was added. this made it so information among other things cannot be attained without a warrent or permission of the person being "searched or in this case located". if apple were to merely locate the ipod without the proper paperwork and authorities involved they could face serious fines aswell as jail time. so even though your ipod was stolen by someone else it is now in their possesion and therefor you cannot turn a feature on to locate it without that persons permission. however the way the "find my ipod app" works is it is designed to locate the ipod alone. this is why it can be activated by the owner with their permission. you can get the police involved however without knowing who stole it the warrent cannot be obtained. im sorry but i hope this helped you understand this isnt apples fault but laws are laws.
