My iphone was stolen at a party last night and I'm worried a fob might've taken it. Unfortunately, I did not have a lock on it nor have I activated my Find My iPhone app on my phone tho I have already downloaded it. I would love to track it down, or at the very least, erase photos or all data if possible. Please help?

There is nothing you can do to locate, lock or erase your dataif you didn't activate Find My iPhone. (What did you thing the purpose doing so was??)
What you can do now is report the loss to your carrier and get service disconnected, as well as report to your local police.

The only way to locate/disable/erase any lost/stolen iPhone is through Find My Phone or a similar app. However, this requires that Find My Phone be setup/activated, on your phone, before it was lost/stolen. You would then login at iCloud.com & try to locate it. This requires the phone be turned on & have an Internet connection. There is no other way to locate a lost/stolen iPhone. Apple can't/won't help you, nor will your carrier. Report the loss to the Police, your carrier & Insurance company. Change all of your passwords.
If your carrier offers Blacklisting & they Blacklist the phone, it will be unusable as a phone.
If locked with a passcode, all a thief or whoever finds it has to do is force the phone into recovery mode & restore it. While this deletes all data on the phone, it also removes the passcode so the phone can then be used as a phone or touch.
There is NO WAY to report any lost/stolen product to Apple.

Also when I am trying to connect ipad to my windows PC, it shows, your software is up to date and later starts restoring while updating again. Then automatically it stops to update halfway and I have to repeat the process again and again, still in vain.

Thanks. Yes. But somehow it's already turned off by the thief. I am just hoping he goes to an area with free wifi to transmit the lost phone mode. I'm giving it a few weeks and i hope that the new iOS 7 function will work. That they won't be able to reset my phone without my apple id & password. I just wish I downloaded the app iHound before.
Oh and I called up our national telecommunications commission and they'll be able to disable my phone's function through my IMEI.

I did actually find the imei number and serial number through Itunes Backup, it was in there. You go into Itunes, then Preferences, Device and it is in there.. Thank you for your help.

Unfortunately if the device is off or not connected or if FindMyiPhone isn't active you can't.

You do not need to install the "Find My iPhone" App.
If you had "Find My iPad" enabled in Settings > iCloud then you may be able to locate it. If not, you cannot locate it.
If it was enabled then you can try locating it via http://icloud.com on a computer or the App "Find My iPhone" on another iDevice. Note: this will only work if your device is connected to a network and the device hasn't already been restored as new and/or "Find My iPad" has not been disabled on it. Note: Disabling "Find My iPad" is much more difficult in iOS 7.
If you think that your device was stolen rather than lost then you should report it to the police. In either case you should contact your carrier, change your iTunes account password, your email account passwords, and any passwords that you'd stored on websites/emails/notes etc.

You will need to restore it as new. unfortunately you will lose any data not saved but you can still redownload all of your apps.

You are able to activate an old device and process an insurance claim for your iPhone 4s within 60days from the incident date. Keep in mind if the old phone is not a smartphone and you currently have unlimited data that feature will fall off. If you have a tier data plan no changes will be made. Make sure you enter your new Id in settings/message, settings/facetime. ANy content that you downloaded with the old ID is forever linked to that old ID and if you have apps that were downloaded with the old ID and you want to update them you can only do that with the old ID. You could delete those apps and downlad them again ( and pay for them if they are not free apps)

That is more than adequate space available. What error message do you see? Which model of iPad do you have? The iPad 1 can not be upgraded beyond iOS 5.1.1.
