i tried to switch on my iPod in the morning but i got the 'sad face'
i reseted it, i re-installed the cd , a restarted my pc, and im still getting the sad face
i tried following the steps on the site and the cd but im still getting the sad face, someone told me that after a year of buying the ipod, the battery expires..but i got my ipod in december so i dont think that counts?
my ipod isnt even being recognised by the computer..
any help please?

If you have a 5G iPod with video, it has to be covered by the warranty because it is less than a year old.

Scroll down and on the right side there is a box to enter your serial number and see how much longer your warranty is valid and when you purchased your iPod. Use that to get your iPod's date of purchase which will be needed if you decide to fill out a service request...

According to the requirements it appears you may be able to run it if you don't have the 8GB version.
The 8GB version was actually a snazzed up second gen with newer iOS software.
If it doesn't see it, the hardware probably doesn't support it.
First make sure you've updated iTunes, then check it again, and if it doesn't show, it probably won't run on it due to the hardware being too slow to handle it.

Open itunes, connect ipod, select what you want to sync ( in the music tab) sync.

It sounds like you may have a 2nd generation iPod Touch. If so, 4.2.1 is the highest iOS. Please note there was never a 2nd Generation 8gB version of the iPod Touch.

- Also try DFU mode after try recovery mode

- If not successful and you can't fully turn the iOS device fully off, let the battery fully drain. After charging for an least an hour try the above again.

Here is a pretty comprehensive post about the sad iPod icon. Be aware that it's quite involved and contains some info that will almost certainly void the warranty. As your iPod is still within the warranty period, you should use that option first.

Yes it's possible to sync music back from a iPod back into iTunes that (I assume) wasn't purchased on the iTunes Store.
Apple allows iTunes Store purchases on devices to be reversed back into iTunes, just not cd rips and stuff like that. For that it's a one way trip to the device from iTunes.
I likely can't suggest such software here, but if you visit iLounge you can ask what is the latest software that works for your platform.
Really it only takes a mere few minutes to backup your iTunes Library and stick in a few cd/dvd's or a external drive. iTunes even has a menu command for it to make it oh so simple. Please use it and backup all your data.
Hard drives fail, computers burn up, thieves steal, stuff gets forgotten. Plan for something happening because it will.

It sounds like you are constantly needing to restore your phone because it keeps going into recovery mode. Usually putting a device into recovery mode and restoring it can help isolate an issue to your iPhone hardware if an issue persists afterwards. I would try manually putting it into recovery mode and restoring it 1 more time:

I've read discussions saying that it is impossible for an iPod/iPad to be infected with the DNS changer bot, but three computers in my house check fine on the governments check site, and on m iPod, it says that I'm infected. The little pop up occurs on my computers and my iPod saying that I'm infected, but only the iPod actually is "infected." Any ideas?

That is correct. There was never an iOS version of this malware. In fact, there is no iOS malware at all, unless you have jailbroken your iPod.

That site works by detecting whether your device looks up IP addresses using one of the formerly-malicious DNS servers that were seized by the FBI in November of last year. The iPod generally gets its DNS server settings from the router. The same is also generally true of computers, though you are more likely to have manually changed the DNS server settings on a laptop than on an iPod, so it's possible your router's settings have been changed to use a malicious DNS server. If you know how to access your router's settings, you should examine them and see what DNS server addresses are being used. Are they in one of the ranges listed at the bottom of the following page?

If so, you need to change your DNS settings in the router. I would probably just reset the router to factory defaults if it were me, but you could also just change the DNS server settings to the OpenDNS servers (208.67.222.222 and 208.67.220.220).
If not, you need to change the iPod's network settings. Go to Settings -> General -> Network -> Wifi and tap the blue circle with a '>' in it that is next to the network you're using. (Also, be sure that it's using the network you expect it to be using, and that it hasn't somehow jumped onto a neighboring wifi network.) Then delete whatever is in the DNS field and change it to the OpenDNS servers.
