Yes, but then you can restore from a backup and get all of your data back. Unfortunately, this also puts the passcode back which sort of defeats the purpose. However, you can just sync all of your data to itunes and then restore and sync again. So you will lose stuff like your settings and app data but you won't lose stuff like music movies, apps, etc.

Before doing any of that, make sure it's asking for your ID and not someone else's ID. It will require the ID that was used to activate the phone originally. If you aren't the original owner, only they can help. You can't. Until the previous owner removes the activation lock, the device is useless to you; Apple won't remove it unless presented with proof that the registered owner is dead.

What is the specific app?
If you have iOS 4.2.1 or later on the iPod and there was version compatible with that version, then you should be able to get a compatible version by:
App Store: Downloading Older Versions of Apps on iOS - Apple Club
App Store: Install the latest compatible version of an app
You first have to download the non-compatible version on your computer. Then when you try to purchase the version on your iPod you will be offered a compatible version if one exists.

The iTunes on my older machine running Vista does recognize the inoperative iPod (iTunes has detetced an iPod in recovery mode) and allows me to restore the device. Error 1604: This error is often related to USB timing. Try changing USB ports, uninstalling and reinstalling USB ports, and other available USB troubleshooting steps (troubleshooting USB connections, device not recognized properly, computer won't recognize a FireWire or USB device). If you are using a dock, bypass it and connect directly to the white Apple USB dock connector cable. If the issue persists on a known-good computer, the device may need service.
If the issue is not resolved by USB isolation troubleshooting, and another computer is not available, try these steps to resolve the issue:
Connect the device to iTunes, confirm that the device is in Recovery Mode. If it's not in Recovery Mode,put it into Recovery Mode.
Restore and wait for error 1604.
When prompted, click OK.
Close and reopen iTunes while iPhone remains connected.
iPhone should now be recognized in Recovery Mode again.
