You need to place the iPod in recovery mode and then restore it via iTunes on yur computer.  Restore from backup if you have a backup.  For recovery mode see:

    Pay serious attention ot Illaass's advice about the police. Don't try recoverying it yourself, or forcing a confrontation with the alleged thief.
