Keep in mind that the recovered photos will not be in their full resolution, but instead will be the scaled down versions that were optimized in size and resolution to fit your iPod's smaller LCD screen.

You can get the photos by importing them from your 3GS to your computer (see http://support.apple.com/kb/HT4083) and then syncing them back to your iPhone 4. Your music should already be in your iTunes library if you have been syncing the 3GS with your computer so all you would need to do is select to Sync Music on the Music tab of your iTunes sync settings and sync your iPhone 4 to transfer it to you new phone. But there is no way for iTunes to see your iPhone 4 as your iPhone 3GS; it will see it as a different device no matter what you do.

The hard drive on my old computer failed so I no longer have access to my itunes library that was saved onto that computer. Is there anyway I can transfer my music and apps to my new computer? I would prefer not using one of those shady online tools... I don't want to lose any of my music or apps since I have some paid ones on there. Yes. You can sync everything that is currently on your iPod Touch to your newer one. Just plug it in and sync it like you did with the old one.

Perform a backup to iTunes from the old device and then a restore to the new device, use ITunes to do this. BTW, always sync photos to a computer to store them safely (use iPhoto on a mac or to a designated folder on a PC). Never trust an iOS device to keep photos without having them synced to a computer.

iTunes includes an option to transfer iTunes content that was purchased/downloaded from the iTunes store from an iPod, iPad, and iPhone, but this is for iTunes content that was purchased/downloaded from the iTunes store only.
First you need to authorize your new computer with your iTunes account with iTunes if you haven't already done so.
With your iPhone connected and without syncing, at the iTunes menu bar go to File and select Transfer Purchases From - the name of your iPhone.
