Note'3 Sim Card Holder not so User Friendly..

If the holder cannot be re-inserted even without the sim card, I would suspect that the eject mechanism has to somehow be reset.

    If the SIM is out of your phone, find my phone needs a data connection, so could use wifi - IF in range of a wifi and one that it can join (ie. a known network or one that is wholly open so no login required).  Your phone could also simple be turned off, so not findable, or it may have been restored (plugged into iTunes and restored as new) again, making it permanently unfindable.  Honestly, for someone stealing an iPhone, this is likely the first thing they do - restore as new and it is theirs forever.
    Find my iPhone is tied to the users iCloud account - the find function is part of the iCloud account's services and it communicates with the iCloud servers over a data connection - either wifi or 3G.
    Have you set up your iCloud account on your replacement phone, and is it working properly on that phone?

    I would imagine your iPhone was hacked to make it work on your local carrier.
    Updating the iOs to 5.xx will lock it back to the original carrier .The carrier holding the lock are the only
    entity able to authorise the unlock .You will have to contact them and see if they unlock and the terms the apply

    Try a Hard Reset.....
    Press and hold the Wake / Sleep button AND the Home button at the same time, keep them both pressed until the Apple Logo appears on the screen, it can take 10 or more seconds.  Ignore the swipe to turn off message.

    Sounds like you got tricked by the person who assured you iPhone was bought from Apple.
    Anyway, Hutchison Telecom owns the mobile carrier 3 and not Vodafone. If hutchison told you that only Apple can unlock your phone well that is incorrect, because my sister is with 3 and she had her iPhone unlocked by providing them the IMEI number, after a week or so she got an sms from them saying unlock is sucessful all she had to do was remove the 3 simcard and insert a different simcard and connect to itunes sync. If unlock is successful you should notice your new mobile carrier in iTunes summary, eject iphone power off and restart your iPhone.
    I'm with O2 had mine unlocked just by filling in the unlock form provided by O2's website,  3 days later received text message that I can connect to iTunes and unlock, simple as that. Although I still have 14 months remaining  on contract O2 provides this iPhone unlock service for free, but only Pay as Go customers need to pay £15.
    Vodafone and 3 are quite doggy to customers and customer services is quite bad, every one has a different answer to unlocking iPhone either they say only Apple can unlock or you have to pay to get it unlocked. In your case try and find out which mobile carrier you are locked to, it can't be both Vodafone and 3. If it's Vodafone then you need to fill out a form on their site, takes about two weeks to get a reply and costs $25 / £15, (friend unlocked on Vodafone Pay as go).
    I hope the information provided is helpful to you, do it the legitimate way and not jailbreak it.

    Every time I switch on the iPhone, the iTunes icon is displayed together with a USB icon and Emergency call message appears on the screen in many languages. When I touch the i symbol I get the following information IMEI: **** AND ICCID: ****
    However, the iphone is visible in the Devices directory in iTunes. I changed my SIM card but still can not be recognized by the iPhone.

    Do you mean when you say its locked to another carrier other then the one im using, that maybe my insurance sent me an iphone thats for a different network for example orange and not mine which is o2?

    First, you do not have a 3G if you could upgrade it to 6.1.3, because 4.2.1 is the last version that will work on the 3G. So you either have a 3GS or you somehow hacked the phone to install an incompatible version. You can check the model you have by entering your serial number here: https://selfsolve.apple.com/agreementWarrantyDynamic.do
    Assuming you have a 3GS the most likely reason for your problem is you have a gray market phone that was hacked or jailbroken to unlock it. When you upgraded it you removed the hack, so the phone is now locked to its original carrier.

    In order to get your messages to show up on your other phone, you would need to have a backup of the phone with the messages, and then restore the new phone from that backup.

    Honestly it sounds like you purchased a no-contract phone and not an unlocked phone.
    Without the receipt it is impossible to say what was really purchased.  Contact Apple to get a copy of the receipt.  If you did infact purchase an unlocked iPhone, then they will resolve it.
    What model iPhone do you actually have?  Paying $700 for and iPhone 4 would have meant it was purchased approximately 2yrs ago.  Also, there is no 35gb model.
    If it is the iPhone 5, the unlocked version was not available at launch but rather released (online only) on November 30th.  Later it was available in store.
