will i be able to get the new update on that day? also will it come out at 12:01 am wednesday morning? i know people will be downloading it as soon as it comesout, but will it affect me in any way ?
You certainly can if you wish. You will probably have to be patient, though. I have little doubt that Apple's servers will be hammered by the tens of thousands of other users all trying to get the new version tomorrow, so you may experience very slow downloads, download timeouts, etc. and have to try multiple times. It's been that way with previous major releases of iOS, and I don't expect anything different with iOS 5 given the extreme interest, though you may get lucky and have a quick, smooth download experience.

If you are using iOS 4 (or earlier) there is no Software Update in Settings. That feature was first added in iOS 5.
To update you will have to connect your iPad to iTunes on a computer (preferably the one you sync with and backup to).

You need a special iOS 7 for your 4th generation iPod touch, and Apple has not released it because it does not meet iOS 7 requirements. The 4th generation iPod touch has got 256 MB of RAM, which are not enough for iOS 7, so you have to stay with iOS 6.1.5

Right now, I feel like driving a nail through it.Me again. I cleaned out the headphone jack with a q-tip soaked with rubbing alcohol. Most of the q-tip fibre was removed to be able to insert it into the jack. After pushing and turning fairly vigorously for a half minute, I pulled it out and a large piece of pocket lint came out with it as well. The Ipod now sounds excellent.
