Operator sold used iphone or repairman swapped my iphone

I bought my brand new iphone 4S from 3HK (3 Telecom Hong Kong) on 16 April 2012 with 2 year phone service and 1 year warranty. The unit failed to power up on 6 June 2012 about 2 weeks after I updated ios5.11.
I took it to the 3HK repair center on 9 June 2012. 3HK refused to repair my iphone or exchange a new iphone for me by claiming that my iphone 4S is not original iphone. My iphone is in my possession 24 hours a day. The unit was functioning normal before it breakdown.  I could still using it to send and receive email before the night before I sleep. Any advice to help me to catch who rip me off : (1) 3HK sold me used equipment as brand new, or
  (2) repairman in the 3HK's repair center swapped my iphone with a used and modified iphone.

If it was not a black screen, normally, you Apple store can exchange a new iphone with you. In my case, I am not sure if the black screen caused by the update of ios 5.11 or something else. So I must entrust my iphone with an Apple authorized service center not owned by Apple.
Does anyone know how to protect yourself about being sold a non-new ipone as new one?
How could entrust our iphone to repair center with a black screen?

    Since the iPhone is not officially sold in Iran, & there are no supported carriers there, you couldn't have an iPhone locked to a carrier in Iran.
    At any rate, if you do have a carrier locked iPhone, you need to contact the carrier the phone is locked to to get it officially unlocked. No one here can help you, nor can/will Apple.

    Did you erase it before you sold it?
    Settings> General > Reset - Erase all content & settings.
    Or did you leave all your personal info on it and give it to someone else?

    You did not follow the proper procedure when selling the phone before resetting it to factory settings. You must help the new owner deactivate the Activation Lock or else he will have the same issue over and over when he upgrades the software or sells it to someone else.

    I believe that all iPhones, purchased in Egypt, from official sources, are sold as carrier locked. So, your phone was hacked by someone so you could use it in Germany. Sorry, but that's what happens to hacked iPhones.
    No one here can help you, nor can/will Apple, and since none of the carriers in Egypt offer official unlocking, your choices are not good.

    Check the eBay listing. Did it state the device was Activation Locked? If not, then make a claim as Meg stated and get a refund. You will not be able to activate the phone and no one can help you contact the owner, unless that is the person that sold the device. If they cannot remove the phone from their account because it is not theirs, then refund is your route. Even Apple cannot assist with locating the previous owner.

    Bad news: It sounds as if you were sold a jailbroken iPhone.
    Good news: File a SNAD with eBay. Make sure all your correspondence has been through eBay Messaging. The fact that the seller has been ignoring you will not sit well with them.
    You will get 100% of your money back, including shipping. Paypal will simply seize his funds and return what is yours.
    Lesson: Don't buy a used iPhone.
    It's much worse for the seller. His PayPal and eBay accounts will be frozen. Until he squares up with both you and eBay, he's out of money and out of business.

    I am not one to give up. So I called AT&T today. Now they are telling me they canceled my order because they were unable to fulfill my order. Basically, AT&T told me they sold out so they canceled my order so I can proceed to reorder again. It took them 4 days to realize this. I will be lucky if I get a new phone by Christmas. I am sure they will find a way to cancel my order again.
    Again, I argued, how is this my fault. I placed my order at the store around 11 a.m. Pacific time. My friend ordered his phone online sometime after me. He got his but my order was canceled. AT&T tried to explain to me that they sold over 600,000 phones, almost 500 per minute during there peak. Again, I asked, how this was my fault.
    I can understand over selling the phone. It is a great product. There is no reason to cancel my order. You adjust my order and tell me you will let me know when my phone will be in. I would have been mad that my phone was going to be late but I would have survived. At least I would be getting one.
    At this point, I have no order and AT&T or Apple website will allow me to order one. I just want to get in the QUEUE for one.
    Frustrated.

    just purchased my new iphone 5 64gb- but does me no good if I cant back up pictures or add my music frm my computer even using icloud. How can I do the things I was able to do with the Iphone 4 now that the 5 will not be recognized at all by my Mac without shelling out thousands of dollar to buy an intel runnung computer just because the Apple software department cannot plug in backwards compatibility to new products such as the iP 5!     So just called apple for the second time about this issue.  First time the tech i got on the phone i think was clue less about the problem. She recommended i buy a cd to upgrade my system and that would fix the problem and my os would be functional with iP5 , iTunes etc...
    So i gave her my computer serial and required info so she could look up my system and make sure  it would work.  I was sold a cd convinced it would work after all apple care techs should know what they are doing right!? 
    Got the cd in the mail pop it in and nothing, error window saying need intel processor to install this cd contents ***! Yea thats what  said today  after the second call to apple.  I did get another hint of hope from the tech i got on the phone today tho.  He really seemed to know his stuff.., so now i fond out apple can replace your processor on certain model computers FOR FREE just pay the parts and you are ready togo with snow leopard and " anything apple throws at your computer" . Going to try this also and will post results soon for all you that may have some hope left...

This is not a hardware issue with iphone Please insert another SIM card from a supported carrier od request from this iPhone be unlocked by your carrier. Please contact apple for more information.
