Partition Journaled-Case Sensitiv issue in Time Machine

Question

Hello,
I changed the harddisc in my unibody MBP (250->500GB). I tried multiple times to make it appearing exactly the same. I created the normal Partition behind an EFI System Partition of 200MB (using iPartition) like the original HD had. I used disc utility to establish the main partition as "Mac OS Extended (Journaled)". I did not use "Case Sensitive"! After that, I checked again in iPartition and Case Sensivity was disabled as expected. I copied the data from original disk using SuperDuper w/o problems. I even performed the sync multiple times to be really sure.
I was able to boot from the new internal disc and the system seems running properly so far. Except: Time Machine keeps stating that it would have to re-create the volume for backup, because "the source volume is not ignoring case sensivity". I tried the whole process multiple times with the same result. Any idea? Maybe, it is important to say I'm running the system in german. Actually, it should not. At the end of this mail, I attached the system info about the disks and partitions.
I also did a small test in order to find out about the real nature of my internal HD (see below). In my understanding, this shows that the volume is not case sensitive, right?
