Performing Rights Clearance

Hi,
I have created a piece of music in Garageband/Soundtrack for use in an advert to be shown on a European cable tv channel.
As the composer I believe I need to give performing rights clearance for use in this advert and was wondering if anybody knows of a document template anywhere for me to do this?
Something which I just need to fill in with the pertinent details would be best, or if any body knows of another way to achieve what I want then I'm all ears.

What country do you live in?
I can't give you specifics, but it depends mostly on the laws in the country where you live (and I don't know what European Union laws apply, if you live within it).
Generally if you're doing music for a commercial advertisement, the production company producing the advert will pay you a flat fee and have you sign what we call a "work for hire" agreement in the USA. The agreement says that they will then own your work outright and never pay you any further royalties.
The alternative is for you to copyright your song and grant the advert company a license to use your song for use in their specific ad campaign for a fee you negotiate. But generally an ad production company wouldn't accept those terms unless your song was already a commercial hit song (like when Apple used U2's "Vertigo" to sell iPods).
You need to find out what the copyright laws are in the country where you live, and then find out how to register a copyright. That would be a good place to start.

  • Is there a way to help Apple check rights clearances at the time of submission

    I am in the final stages of producing three iBooks, have images, audio and video from various sources. I have the rights to reproduce them, signed contracts with all the copyright holders.
    My question is, it would see that when the book is being vetted by Apple, they would see all of this conent from various souces and want to verify that I actually have the rights to the content.  Is this something that could hold the approval process up? Is there a way to assist them in vetting the rights clerances, perhaps a form to submit that I am not aware of?
    Is this something that happens during the upload preperation in producer?

    I think that's unlikely. If your book contains media for which you do not have rights, the copyright violation is made by you, not by Apple. The only requirement Apple places on you is to add an appropriate copyright notice to your book:
    Publisher shall provide an appropriate copyright notice in the Content File, or as reasonably requested by Apple, which Apple shall display for each eBook.
    So, there is no need for Apple to check the rights for each and every image in a book. (If they did that, it would take much longer for books to make it into the store than it does now, not to mention the cost of such an exercise.)

  • G5 is not performing right...

    hi, I had my computer for almost 3 years and never did a format or emptied cache on browsers or whatever. lately, the computer just seems to not be solid.
    when I view websites, it takes a long time before they appear (sometimes) and I have gotten this weird message. the displays go gray and it says please restart your computer.
    I have no idea if there is a way to test out like each fan, RAM, HD, processor, etc. but they say if it runs, it's good. I have done disk utility and it has said there were errors on my internal hard drives and one time it said it couldn't fix it but I ran it again and it seemed to be fix hence it said it's ok.
    I also have tech tool but now it crashes EVERY time I start it up. when I run the update for the latest version, it crashes the eDrive when I install it so I cancel it because I hate having corrupted stuff - OCD is what I have. =/
    so basically, how do I totally reset EVERYTHING to default stages AND would it be best to buy a new internal hard drive and ONLY have that pluged in and install the latest OS or what? =/

  • Why is browser performance so bad on my new iMac?

    I'm using the latest generation iMac 27 inch with the dual 3.2ghz i5 processors, 8GB of memory, and 1TB HD. Over the past few days I've noticed the page rendering speed of this iMac using Safari has gotten embarassingly bad. I haven't seen problems like this since I was on dialup AOL on my original 7500/100 in 1997. Honestly, my iPhone 4 displays pages incredibly fast just using 3G, so this is really disappointing for a $2k+ computer.
    I enabled the Dev menu and emptied the "caches" (not sure why there was a need for a plural there...), and the performance got worse. I've also tried Opera, OmniWeb, Firefox, Camino, and even Sea Monkey. All of them are affected to some degree. Some put the text up fairly fast, and then spend quite a bit of time loading images, with or without placeholders. Some just sit on a blank page and do nothing for several minutes. I've had quite a few default to the old Lynx-style text pages, like I had followed an old Tripod page link and then backed my way up the link into the owner's user directory.
    I thought that my local net connection may have been a problem, since it was delivering about half its rated speed just a few days ago. However, I loaded up both the DSLReports and Speedtest sites and found that my connection was at a strong 10mb/sec rate. Interestingly, those two sites loaded fairly quickly.
    This is happening globally, across a wide range of both Webkit and KHTML browsers. Is there a pref somewhere that needs to be adjusted?

    I made sure Onyx was up-to-date and ran all the schemes you listed. That did nothing. However, reading further in your support thread gave me some ideas. I started looking into third party extensions and plugins. I recalled installing Silverlight a few days ago, for what reason I have no idea, since I trust Microsoft only marginally more than I trust Google. Which is to say, I don't trust either of them at all. So I threw that plugin into the trash.
    I should have checked the performance right there, but I didn't. Right under Silverlight, you mentioned Flash. I decided to check the prefs on it, and found that it was set to allow sites to save info to my computer, and Camera/Mic and Playback were changed from "Block" to "Ask Me". I distinctly remember setting those for maximum privacy. I reset them, cleared all the files, and exited the prefs.
    I just checked them again, and everything is changed back to allow Flash to have its way. Looks like I'll be uninstalling that now...
    I also installed Acrobat recently, just to have an alternative to Preview. Sea Monkey opened an alert box just now, telling me to watch out for the Acrobat plugins, as they've been known to cause problems. Gotta love Adobe.
    Back to the topic at hand, I think it was the Silverlight plugin that caused the slowdown. All my browsers are running at full speed now after I threw that plugin out. (Now if I could just get Safari to allow me to back up a page without re-rendering it every time...)

  • Query performance vs MySQL

    I have a table with about 500 million records in it stored within both Oracle and MySQL (MyISAM). I have a column (say phone_number) with a standard b-tree index on it in both places. Without data or indexes cached (not enough memory to fully cache the index), I run about 10,000 queries using randomly generated phone numbers as criteria in 10 concurrent threads. It seems that the average time to retrieve a record in MySQL is about 200 milliseconds whereas in Oracle it is about 400 milliseconds. I'm just wondering if MyISAM/MySQL is inherently faster for a basic index search than Oracle is, or should I be able to tune Oracle to get comparable performance.
    Of course the hardware configurations and storage configurations are the same. It's not the absolute time I'm concerned about here but the relative time. Twice as long to perform basically the same query seems concerning. I enabled tracing and it seems like some of the problem may be the recursive calls Oracle is making. Is there some way to optimize this a bit further?
    Realize, I just want to look at query performance right now...ignoring all of the issues (locking, transactional integrity, etc.)

    In Oracle, a standard table is heap-organized. A b-tree index then contains index keys and ROWIDs, so if you need to read a particular row in the table, you first do a few I/O's on the index to get the ROWIDs and then look up the ROWIDs in the table. For any given key, ROWIDs are likely to be scattered throughout the table, so this latter step generally involves multiple scattered I/O's.
    You can create an index-organized table or a hash cluster in Oracle in order to minimize the cost of this particular sort of lookup by clustering data with the same key physically near each other and, in the case of IOTs, potentially eliminating the need to store the index and table separately. Of course, there are costs to doing this in that inserts are now more expensive and secondary indexes are likely to be less useful. That probably gets you closer to what MySQL is doing if, as ajallen indicates, a MySQL table is generally stored more like an IOT than a heap-organized table.
    If you get really creative, you could even partition this single table to potentially improve performance further.
    Of course, if you're only storing one table, I'm not sure that you could really justify the cost of an Oracle license. This may well be the case where MySQL is more than sufficient for what this particular customer needs (knowing, nothing, of course, about the other requirements for the system).

  • Design Patterns, OO Design, and J2ME performance

    Hello- I am a J2ME newbie. I am a design patterny/OO kind of guy using J2SE. I'm trying to create a facade for the business logic on a project I'm working on which will work on both J2ME and J2SE. I have come up with an acceptable design, but I am afraid that the bytecode may end up being way too large for J2ME. For example, I used the command pattern for some functionality, which results in many small Command classes, which is nice for extensibility and functional encapsulation, but creates extra bytecode. Another example is I like to throw specific business exceptions, however, those also require a separate class for each exception. Another example is I like to use TypeSafe enumerations, again, new, unnecessary classes.
    I am aware of some workarounds (create a generic business exception, just put info into the message, don't use the command pattern, use bytes for non-typesafe constants), but I find myself resisting due to my hardcore OO/best practices tendencies. I guess J2ME is a whole different programming paradigm. How are you guys dealing with these issues? The most important issues with J2ME programming are small footprint and high performance, right? I guess I could write more procedural-ish code, but I am interested in any compromises that the OO guys here have come up with. Also, what size is an acceptable library/sdk in J2ME?

    I'm not an OO guy, but I can definitely say that you'll will have to find some comprmises in your designs (the generic business exeption is a very good example).
    Since you are making business apps, you do get some leeway on two issues:
    * As opposed to games, where every cycle counts, for a business app maintainability and scalability are you usually more important than performance, so OO techniques will often be a better choice than a slightly faster implementation.
    * You probably have more control over the devices you will be targetting. The most common limitation for MIDlet size these days is 64KB, so a library that more than 20-30KB probably won't be any good on these phones. But if you know your apps will be run on higher end phones you can make it a lot bigger, since they can often have MIDlets that are up to several MB in size.

  • Brush Lag? - Here are OpenGL settings that improve performance

    For anyone having horrible Brush lag, please try the following settings and report your findings in this thread.
    After much configuring and comparing CS4 vs CS3, I found that these settings do improve CS4's brush lag significantly. CS3 is still faster, but these settings made CS4 brush strokes a lot more responsive.
    Please try these settings and share your experiences.
    NOTE: these do not improve clone tool performance, the best way to improve clone performance right now seems to be to turn off the clone tools overlay feature.
    Perhaps Adam or Chris from Adobe could explain what is happening here. The most significant option that improved performance appears to be the "Use for Image Display - OFF". I have no idea what this feature does or does not do but it does seem to be the biggest performance hit. The next most influential setting seems to be "3D Interaction Acceleration - OFF"
    Set the following settings in Photoshop CS4 Preferences:

    As I am having very little problems with my system I though I should post my specs and settings for comparison reasons.
    System - Asus p5Q deluxe,
    Intel quad 9650 3ghz,
    16gb pc6400 800Mhz ram,
    loads of drives ( system drive on 10K 74gb Raptor, Vista partition on fast 500gb drive, Ps scratch on an another fast 500gb drive, the rest are storage/bk-ups ),
    Gainward 8800GTS 640mb GPU,
    30ins monitor @2560x1600 and a 24ins 1920x1200,
    Wacom tablet.
    PS CS4 x64bit
    Vista x64
    All latest drivers
    No Antivirus. Index and superfetch is ON, Defender is ON
    No internet connection except for updates
    No faffing around with vista processes
    Wacom Virtual HID and Wacom Mouse Monitor are disabled
    nVidia GPU set to default settings
    On this system I am able to produce massive images, the last major size was 150x600cm@200ppi and the brushes are smooth until they increased to around 700+ pixels then there is a slight lag of around 1 second if I draw fast, if I take it slow then there's no lag. All UI is snappy.
    I have the following settings in Photoshop CS4 Preferences:
    Actual Ram: 14710MB
    Set to use (87%) :12790MB
    Scratch Disk
    on a separate fast 500gb - to become a 80gb ssd soon
    History state: 50
    Cache: 8
    OpenGL - ON

    EDIT: I should also add that I Defrag all my drives with a third party defrag software every night due to the large image files.

  • Improve the query performance

    Hi, I need help for improving query performance..
    I have a query in which i am joining 2 tables, join after some aggregation. Both table has more than 50 million record. 
    There is no index created on these table,both tables are loaded after truncation. So is it required to create index on this table before joining? The query status was showing 'suspended' since it was running for long time. For temporary purpose, i just executed
    the query multiple times by changing month filter each times. 
    How can i improve this instead of adding month filter and running multiple times

    According to your description, you are joining 2 table which contain more than 50 million records. Now what you want is improving query performance, right?
    Query tuning is not an easy task. Basically it depends on three factors: your degree of knowledge, the query itself and the amount of optimization required. So in your scenario, you can post your detail query, so that you can get more help. Besides, you

  • Improving AE CS5 Performance.

    Hi guys, wondering if you could help me out as I have tried several other avenues but to no luck.
    I have been a frequent AE user since AE 7 and noticed a gradual increase in performance on my old setup which was:
    Vista 64 Bit
    Asus P6T
    i7 920
    6gb kingstong ddr3 at 1066MHZ
    Samsung HDD 750gb.
    2 X ati 4850 later upgraded to a 1gb nvidia 560ti gtx card.
    With that set up everything, including the additional textures and particle videos etc from stock footage was on the Sansung HDD.
    I now have a slightly different but more powerful set up which is:
    Windows 7 64 bit.
    Asus P6T
    i7 920
    18gb of DDR3 Ram at 1066MHz.
    120gb OCZ Agility 3 SSD.
    Geforce 560TI.
    I've highlighted the SSD because I was expecting a massive increase in performance right from the outset and with all my games and all my application there is a huge increase in speed, everything loads up much quick and everything runs smoothly, apart from After Effects and this concerns me.
    With AE CS5 installed on the C drive, the C drive sits on the SSD and it is the only partition, I've got more than 55gb still free.
    I don't understand why After Effects is now actually loading slower from the SSD than it was with my old set up when it loaded from the HDD. It takes over 2 mins, it used to be about 20 seconds.
    Not only is the application load time slow, my ram previews of complex compositions is rubbish, because I could get maybe 30-40 frames to run smoothly, now it's just 2/3. It just doesn't seem right. AE is the only application affected.
    Any ideas?
    Yes I could re-install, but I want to avoid that as I've installed some of the redgiant plugins and I don't want to go through all that again.

    Reinstalling doesn't affect third-party plug-ins. The installer doesn't care and will leave all unknown files in place, so it's irrelevant. The rest sounds odd and could be anything from permissions issues to media cache being slow. if you can, point your cache folders to anotehr location then the default. Check the prefs on that. Also there may be specific issues with your graphics card, so naturally, check the driver and update it if necessary...

  • Project Server 2013 Poor Performance

    Hi Guys
    On a new build of Project Server, we are experiencing poor performance across the board, Site Collection, Central Admin, everything is slow.
    We have allocated 12GB and Quad core (lower end of the recommend scale). However as there are no users, I would expect it to be fine at the moment (Search is not setup or anything, just a simple service app with a pwa site provisioned).
    What things can we check? From looking on the internet, Distributed Cache crops up a lot. Can this bring performance right down?
    For the record, we have March 2013 PU and Oct 2013 CU applied.

    There could be a number of causes, it is very difficult to diagnose without understanding the farm infrastructure. Can you give details of:
    Number of servers in the farm + Specs
    If virtual, is the host server over committed? Have you set up reservations for memory and CPU?
    What is the storage?
    What is the network speed between servers / storage etc?
    Do you have any Anti-Virus software installed on the servers? If so, have you tested with it disabled on all servers in the farm?

  • Will more ram increase my performance?

    I'm running Logic Pro 7.1.1 on a Powerbook G4 1.67 with 1 GB of ram installed running a fair amount of sample libraries and effects. When I check the Activity Monitor under system memory I get the following:
    Wired: 108 MB
    Active: 600 MB
    Inactive: 300 MB
    Free: 13 MB
    Since I still have a decent amount of inactive memory, does that mean that more ram would not affect my performance? Or will more ram help out with system overloads?

    i'm always careful in wholeheartedly saying 'yes' when people ask if more RAM will give more performance.. while of course it will in almost every case help things along, sometimes quite dramatically, I think it's important to be realistic about what it actually does.
    it's easy to have the misconception that more RAM = more plug ins on some kinf of linear scale -- I had 2GB, so now with 4GB I should get something like double the performance, right? just as long as you're clear why this isn't the case, then that's the main thing.
    I think since the days of CPU cards like protools TDM, the confusion is out there that adding RAM is like adding more DSP. so you just have to be careful that you understand what it's doing any why it can free your system up to do a little more. you can indeed see decent increases if your machine was struggling along before, given what you were trying to get it to do. or, it may just be a subtle thing.
    IMO the best way to think of it is this. your machine has the capacity to perform up to a certain level. when you start getting it to do a lot of things, you will start creating a hindrance to it performing as fast as it can as soon as there are moments when it doesn't have enough RAM to do it. this amount will be different for everyone, dependant on your own use. so, the best thing you can do is remove the bottlenecks, and you'll best let your machine go as fast as it will go.

  • Any Tips on Maximizing Computer Performance?

    Windows has defrag and disk cleanup for all of their unresolved problems, but does Mac have an equivalent program to give the computer an extra push? I'm perfectly fine with my performance right now, but who would complain about getting a bit extra out of it? I'm running on my Intel-Based MacBook on OSX10.4.11

  • Shall I buy a 3D television for live performances???

    Couple of day back I got an idea to buy a 3d TV for watching live performances; at times its bit hard to book the tickets on time and hence, we missed out many of the live concert due to the unavailability of tickets. In near future we are planning to join few of the concerts listed below:
    1. GMA concert series.
    2. 2012 Toyota concert series
    How many of you would advise me to buy 3D TV for doing the same? I thought as per the advertising statements if we bought any good 3d TV we could feel our programs as real, isn’t?

  • OES linux "rights" command, [Public] user and Windows woes

    Hey all,
    I've been trying to figure out a solution for this, and although I thought I figured it out, it ends up I can't seem to figure it out. Hear me out.
    We run an automated ZCM imaging system, and part of that is the ability to have any user authenticate on successful image using the Novell client. Once this is done, the first login should start installing a series of bundles/applications.
    As MS Office 2010 is a rather large install, I keep the files/folders stored on a NSS volume, aptly named:
    //oesserver/media/nss/APPS/MICROSOFT/MS Office 2010 SP2 - Admin Install
    I would like ALL users to have access to this directory but since we run on a weird container layout, and our licensing permits for a rather large number of installs, I wanted to give the [Public] user read+filescan rights to each server's /media/nss/APPS/MICROSOFT/MS Office 2010 SP2/ directory, so regardless of where you are mapping with any user, that user would then have access to said folder.
    If I use either the iManager plugin or directly using the Novell client method of applying [Public] as a trustee, it works, and the client can see the folder.
    I have over 30 servers that each have the identical path, so in my sleuthing I found the OES command to perform: rights
    So I performed the following command:
    rights -f "/media/nss/APPS/MICROSOFT/MS Office 2010 SP2 - Admin Install" -r rf trustee [Public]
    If I then show the results, there are successful:
    rights show
    The problem, however, is that within Windows, from any login, when I right-click the folder and check the trustees, I do not see that user in the list, and in return, that user has no access to the directory.
    If I then run my command to remove the rights from the OES server:
    rights -f /media/nss/APPS/MICROSOFT/MS\ Office\ 2010\ SP2\ -\ Admin\ Install/ -r none delete [Public]
    And then run a "rights show" again, the Public user is removed correctly.
    What I can't seem to figure out is why the command will allow me to set trustee rights to [Public], that "rights show" will validate that the rights are currently assigned, but from a Windows perspective I have no access to that directory.
    I have done a "rights show" on the drive when assigning the rights from the Novell client and/or iManager, and there is NO difference in how "rights show" see the [Public] user listed.
    Has anyone else ever seen this?
    If I specify a user in my tree, it works correctly on both ends.
    rights -f "/media/nss/APPS/MICROSOFT/MS Office 2010 SP2 - Admin Install" -r rf trustee username.ou.o.tree_name
    rights show will then show me the appropriate trustee, and the user can see the path in Windows.
    This restriction seems limited to the [Public] user, but I have no idea how to do this properly.
    I'd like to avoid doing it by hand, because I want the ability to script all my changes and remotely and efficiently.
    Any advice?

    fixed by installing the April 2014 OES11SP2 Hot Patch for NCL.
