I haven't let the bugs introduced in the adjustment panel fly-out panel in CS4 I reported the bugs in CS5 for I skipped CS4 for I knew there would major bugs in CS4 for Adobe was adding GPU support in CS5.  I submitted the bug report in CS5 2010 and was recorded by Adobe Phone support.  To pass to senior support team.  Adobe Acknowledge the bugs and closed the bug report stating they may fix it in a future release.  I re-open the case and support wanted to know why. Adobe support repeated their request they want me to close my bug report I replied no do whatever you want. Adobe Support withdrew my report.

Unfortunately, both issues were deemed low impact with known workarounds which is why they were deferred. Sorry.  There is no satisfactory work around all acttion new and old need to be edit and changed ro take advantage of bugs in the implemetation for the onlr access to the options is manually using the fly-out menu.

I thought great he wrote Scriptlistener he is good  but what the cam up with dis not address the problem after a few e-mail exchages I feel managment must  have pull him for he no longer communicate with me.
I will not go away for new and old action that add adjustment may fail to work properly unless recorded in a way to take advantage on bugs in the implementation of the options.    All I'm asking for is tow simple line of code to be added to the fly-out menu code.  Add  a line before the code the generated the separation line before the two bad option add
/* removing two bad options
then scan down to where the next separation line is added and before that code add the following:
   the bad options have now been removed */
One again Photoshop will not have bad options and new and old actions will work
