Photoshop CS6 actions: close two windows and switch to third one

Hello all,
I am having trouble trying to switch to next active window using actions, right after closing the first two documents. What I need my actions to do:
1. Copy the second document and paste it into the first
2. Save the first document.
3. Close the first document without saving
4. Close the second document (no saving needed)
5. Repeat
I encounter the error "The command "close" is not available" as soon as I close the first window. I'm guessing that, since there is no longer a reference document, it can't move to the following one. This also happens if I reverse the order or if I select the third one (to become first after those two are closed) and delete the previous two.
How could I solve this problem?

Ok I found out how:
I had everything in a single action. What I needed to do is to close the second window in a different action and that's it. Simple .
Which brings me to a secondary problem:
Whenever I open several files at once, sometimes it will place the first image in the last tab. This happens randomly and for no apparent reason. Whenever this happens, even if I move tabs to the right order, the action mentioned above about copying a document and pasting it into the previous one gets messy (wrong recipient documents). I guess Photoshop automatically numbers tabs and the numbering stays the same even if you move them. The only thing I can do is delete both wrongly placed images and run the batch.
How can I prevent this (automatic placing of the first image in the last tab) from happening?
