Please help.... do I have a 2nd or 3rd gen iPod touch?

I bought an iPod Touch for my father in February from an Amazon seller (happybook1). I ordered a 3rd generation iPod Touch on purpose because I don't have Snow Leopard OS and I wanted to be able to plug it into my OS 10.4 computer.
Yesterday my father decided to bite the bullet and asked me to upgrade his iPod Touch from iOS 3.1 to iOS 4.1. However, when I tried it kept freezing (not the issue here). I wen't to apple.com and put the serial number into their warranty section and it said the iPod is a 2nd generation iPod!!!!!!!!!

Angrilly, I wrote the Amazon seller and insisted she give me a refund.... I couldn't believe she had sold me a 2nd generation iPod!! But she immediately responded with this:
Thank for your e-mail, the ipod I sent you is considered the 3rd gen, its part number MC086ll/A  is the part number matches amazons listing category for the 3rd gen.  You can find this part number on the bottom of the box as well as under settings.
The part number for the 2nd gen. touch is MB528LL/A.  The model MC086ll/a does show in apples website as a 2nd gen because the only difference between the two is that the 3rd gen. model MC086ll/a came preloaded with the iphone 3.1 software and the second gen. didn't.  So apple changed the part numbers and the software from the 2nd to the 3rd but it will show as a second in their website, there is no touch that shows as a 3rd gen in apples website.
Apple can verify this with you if you call them but I just wanted to explain why it shows that way in there site, but I did list it in Amazons 3rd gen. category because it is listed by the part number and they categorize it as a 3rd.
So I just wanted to let you know I didn't list it wrong you can check it by the part numbers in Amazon.  Apple is up to 4.2 software version now so it will prompt you to update the software anyway when you connect it so you should have the lastet software.  Is the ipod working ok now that you updated.
Now I'm confused.... do I have a 3rd gen or is this seller just lying her pants off??
I was able to restore the software into 4.1 but it is sluggish..... I'm thinking because it is really a 2nd gen with a slower processor?
Can someone please help me to figure out the truth?? Should I insist she refund me (though she probably won't) or accept this answer as the truth? Does it make a difference... the difference between 2nd adn 3rd gen?

Look at the back of the iPod. What model number is actually shown on the unit? And what is the capacity of the unit? If it's an 8GB iPod touch it's a second-generation, regardless of what your seller is claming. Apple never made a 3rd-generation 8GB iPod touch. Some resellers incorrectly refer to the 8GB with iOS 3 as "3rd generation", but that was never a designation approved by Apple."3rd-generation" properly only applies to the 32GB and 64GB iPods Apple released in September 2009, models which have faster hardware.

    You may have to consider, if possible, a visit to an Apple Store with Genius
    bar. Usually it's best to try & set an appointment. If you know an actual Store
    you may call and ask if they can help you set a time to discuss this issue so
    as to save you some trouble with using the online Genius bar scheduling.

    The iPod Touch you have may not accept the latest iOS8.x system, so if you
    have older marginal Apps, they would not work and may not have equal or
    similar replacements under the latest iOS version. iOS7 may not be available
    and if you should upgrade to iOS8, you probably won't be able to revert back.
    After looking around Support online, I do not see a method of restoring Safari
    but your device may have one built-in to it; perhaps part of a reset process.
    I am not certain... There are some items you may have to attach the Touch to
    a computer and use it to see about updates or replacement software.

    To ask a knowledgeable product specialist, and have the iPod Touch model
    and serial number handy, may be the best way to go. Expect that with any
    upgrade to a newer iOS system software, old apps won't work and new ones
    that could be available, may not look, feel or act in the same way as old ones.

    My ipod touch (2nd or 3rd generation) won't recognize headphones anymore! I have'nt gotten it wet or dropped it. I've tried cleaning out the plug where you plug the headphones in. I've had no luck. Is this fixable or is it time to trash this iPod?

    - Try cleaning out/blowing out the headphone jack. Try inserting/removing the plug a dozen times or so. There is a little switch in the headphone jack that disconnects the speaker when the headphone jack is inserted.
    Try the following to rule out a software problem
    - Reset the iOS device. Nothing will be lost
    Reset iPod touch: Hold down the On/Off button and the Home button at the same time for at
    least ten seconds, until the Apple logo appears.
    - Reset all settings
    Go to Settings > General > Reset and tap Reset All Settings.
    All your preferences and settings are reset. Information (such as contacts and calendars) and media (such as songs and videos) aren’t affected.
    - Restore from backup
    - Restore to factory settings/new iOS device.
    - Make an appointment at the Genius Bar of an Apple store. Seems you have a bad headphone jack.

    I took the iPod to the local Apple shop. The guy put the iPod onto a docking station and checked it - answer "connections are OK".     Be sure it is really a 3rd gen. Some people with 2nd gens were told they were 3rd gens.  Identifying iPod models or Look up specs by Serial Number. If it is a 2nd gen, then you can't upgrade.
    IF IT REALLY IS A THIRD GEN iPod Touch, then you first need to upgrade to iTunes 10.5 in order to download iOS 5 because older versions of iTunes don't support and can't sync with iOS 5.

    It seems like your iPod touch is not recognized by iTunes on your Mac, but your iPhone 6 is working normally.
    I recommend starting with these steps to troubleshoot your iPod touch and connection with your Mac:
    Check your USB connections
    Unplug other USB devices from your Mac and try again.
    Try a different USB port.
    Try a different USB cable.
    Restart your device
    Restart your iOS device or reset your iPod.
    Restart your Mac
    Turn your Mac off and back on.
    Update your software
    Check for software updates on your Mac.
    Check for an iTunes update.
    Check your security software
    If you have security software installed, learn how to resolve issues between iTunes and your security software.

    Change your iCloud ID password: http://support.apple.com/kb/HT5624.  After doing so, go to Settings>iCloud, tap Delete Account, then sign back in with the new password.

  • Need Help w/ iOS 5 update issues for 3rd gen ipob touch

    I have a 32gb 3rd gen ipod touch. Since updating to iOS5 none of my itunes library reinstalled and I couldn't download any podcasts until I deleted about 20 apps. Now if I want to download a podcast it tells me I don't have enough memory unless I delete one I've already listened to. Does the iOS5 really take up that much space?!?!
    How can I fix this?

    With your iPod connected to the computer click on the iPod under Devices in iTunes and look at the distribiution of the capacity usage of the iPod in the colored bargraph near the bottom. If the "other "category is very large, like >1 GB that is problably the problem.  To reduce the "other" you need to retore you iPOd.  Sometimes restoring from backup works but other times resoring to factory defaults/new iPod is reqquired.
    If the large "other" is not the problem what is using the storage on the iPod?

    You need to update the OSX on your computer. Going higher that 4.1 requires iTunes 10 or higher. iTunes 10 requires OSX 10.5.8 or higher.
