It would appear that you can ask for an exchange but it doesn't specify any time frame... Hopefully someone more knowledgeable can add to this.
By the way, if you've replaced the drive so many times, perhaps there's something else going on elsewhere.

If the same website is opening each time you launch a browser (Safari?) hold down the shift key as you launch to prevent previous pages from opening.
Have a look at your settings in Safari > Preferences. Especially General and Privacy.
Reset Safari to remove cookies and other stored data.

If you're running Mac OS X 10.8.x ou can purchase iPhoto version 9.x from the App Store. If you purchase iPhoto at the App Store you will automatically get the most up-to-date version and you won't need to install the 9.4 update.

As long as your MacBook Pro is in the ML compatible list, http://www.apple.com/osx/specs it is compatible with Mavericks and you can go directly to Mavericks.

If you just do a normal time machine backup on your macbook pro and then plug that harddrive into your new air; you should be able to just use migration assistant to transfer all your files. You wouldnt need to upgrade to mountain lion on your macbook pro.

Did you format the drive for Mac use before you tried to use it as a backup drive?
Are you using Time Machine on the drive? You can't view the contents of its backup database and the only way to access the info is directly from the Time Machine app.

If you make an appointment at the Genius Bar about a problem, they will check and evaluate the device, and if it warrants a replacement under warranty, they make the final determination. Apple charges less for OSX upgrades than most apps cost. I wouldn't bet on having them separated out, but you can use Messages now, since it's a beta. But I believe that even that gets shut off by Apple once 10.8 comes out.
I think you should just focus on getting Mountain Lion. Also, remember, the Terms of Use for this forum precludes us from speculating on what Apple will or won't do with new products/software/etc.
