Replacement phone has iOS 7.2 backup from old phone is in iOS 7.1 it will not allow me to restore replacement phone to backup, anyway around this?

Replacement phone has iOS 7.2 installed backup was created in ios 7.1 anyway to restore replacement phone with my backup files? I tried updating the software on the broken phone but it says it is up to date.

You must mean that the replacement iPhone has iOS 7.0.2 since there is no 7.2 version, 7.1 is the current version.  If your backup was created with iOS 7.1 it will not restore to an iOS 7.0.2 iPhone.  If the iPhone will not update to 7.1 for you, take it back to the Apple store and have the genius bar staff update it so you can restore your backup.
