Shoddy Product Nokia Asha 311

Question

I purchased this phone on 10th Sept 2012. In the first week of October, the touch screen would not function, rendering the phone useless. I was informed that it was a software problem and would require the phone to be sent to the service centre for at least a day. I was furious as the phone was new but I was informed that as these are electronic goods, there can be no certainty of fault-free performance. This made me even more angry as I believe the company spends a lot of money on advertising that persuades customers to the contrary, if not in as many words, then by implication. When I asked if I could get a substitute phone so I could be connected till my phone was repaired, I was informed that is not possible.
Anyhow, the phone was repaired and received back after a day in working condition. What has really upset me now is that the same problem recurred. I took the phone again to the store and demanded my money back as any ordinary customer would. I was told there is no money back policy and the fact that the phone is an electronic item etc etc was repeated.
I am without a phone for a second time, within two months of purchase. This seriously inconveniences me. I am also terribly disappointed that the staff at the dedicated Nokia store immediately started to inform me about the fine print regarding the purchase which makes it clear that the customer has no choice but to stick with the absolute lemon that he has been sold.
I have been asked to email my complaint, upon which the company MAY consider replacing my piece.
