So i bought an iphone 4s second hand, and when i first turned it on i updated to the software.. it then kept restarting, i did everything, any help?

So i tried factory reseting, rebooting, everything. it didnt work, i gave up and went back to it 10 minutes later to find it working, it lasted a day without restarting, although charging it all night the battery stayed at 54% for the whole day not going down, i charged it again last night and it stayed at 54% again, about 15 minutes ago it turned off and wouldnt turn back on, so i plugged it into the charger, it came on and was 100% battery, then died again and came back on at 2% .. im continuing to charge it but it goes off and on and when it comes back on the battery % has gone up by 2% each time, can anyone tell me is a battery replacement needed?

Restore it.
Restore it as new.
If these fail, the it is likely a hardware issue.

If you're able to contact the previous owner, send them this link and tell them to follow the instructions.
If not, you can't activate the device but may be able to get it refunded.
Apple won't remove the lock for anyone other than the original owner(assuming they're alive.)

Clear the receiver

If I am understanding you correctly, it sounds like you are returning to an old iPhone that has been erased and you would like to set it up as a new device without restoring from a backup which would affect the name of your iPhone, as well as the contents therein. Basically, it seems like you may be stuck on a screen that is asking if you would like to restore your device from the backup that is filed under the name of your new iPhone, or if you would like to set up the device as a new device. Sorry, but you can't use that iPhone. The activation lock is an anti-theft measure; Apple won't unlock that device for you.

Generally, that means the phone has been jailbroken (hacked). You can try restoring it as new using iTunes. Beyond that, there's really nothing we can advise as jailbroken phones can't be supported on these forums.
