This will be covered by the 1 year Warranty. Make Genius reservation or set up service and take or send to Apple for resolution. Until then try Settings App > Accessibility > Assistive Touch > ON > tap new white screen button > Device > Lock Screen. This can even turn iPhone OFF. To turn ON, connect to power, charger or USB of computer.

If not then nothing in it is safe and I would suggest changing passwords to all accounts you had on the iphone ASAP. Also if you had find my iphone activated on the phone then you could go to icloud and wipe the phone remotely. If you didn't then there is nothing you can do about it.

No, you should not. There are problems trying to go the other way, but updating a newer iOS release from a backup of an older iOS release has always been supported and is the basic means of setting up a new device from a previous one.

My question is: Can a person access my personal data on the phone?
