You should call Apple Support and give them your Apple ID so that they can verify how many photos you actually do have backed up in iCloud...
Also, are you able to do an iTunes backup at all? Because that would save all of the photos and allow you to get them onto the new device.

OP you need to be more specific. ARE you saying that they did not restore from your icloud backup? Or are you saying that they didn't show up under your photostream?
If its the 2nd one, because photos are only available to other devices in your photostream for 30 days. Beyond that, they only show on the original device. To get around this, you can, on the original device, share them all to a shared photostream, inviting only yourself to share the photostream and them you'll be able to access them on the new device. Fair warning, sharing them to the shared photostream can take some time so don't delete them till they all show up.

For Mavericks you need to upgrade to iPhoto 9.5.1.
You cannot buy this version from the AppStore, since the current version is iPhoto 9.6, and that requires Yosemite. The easiest route for you would be to upgrade to Yosemite. And to upgrade iPhoto you need to buy an iPhoto '11 installer. It comes as part of iLife '11. You can try to buy a boxed version from Amazon or try to find it at eBay. Once installed on Mavericks, download the iPhoto '11 updaters from the apple Support Downloads page.

Photo stream photos are only saved in iCloud for 30 days (even though up to 1000 will remain on your devices until deleted). If your photo stream photos are over 30 days old, they are no longer in iCloud.

If the photos are camera roll photos they would be contained in your iCloud backup. Restoring the entire backup should recover them, along with your other data and settings. To restore to your iCloud backup, go to Settings>General>Reset, tap Erase All Content and Settings, then go through the setup screens on your phone and when given the option, choose Restore from iCloud Backup.

Specifically, no. Unless you had already transferred the Camera Roll those pictures are not recoverable. Furthermore, unless you have a current backup on iTunes you won't be able to recover anything more recent than the last backup. If your other photos are already in iPhoto, then they can be restored to a new device.

Trying to get Saved Photos from my iPod to my Computer

Hi there
I am a Windows Vista user and i have owned an iPod Touch 2nd Gen 16 Gb for many months.
Before i have updated from 3.0 software to 3.1, i used to access the 'Saved Photos' frolder on my ipod by going to My computer and d.clicking on the ipod icon and there was the folder with the photos i have saved on my ipod, for instance photos i saved from the web browser or backgrounds i saved from some applications.
Now, there is no iPod Touch icon in My computer ever again, nither when ipod touch is connected and being synced nor when the sync is finished. Simply, i can not find a way to access the saved photos folder after the update.
Does anyone know if maybe there is some new setting in iTunes that turns on this convenient function on an iPod touch?
I know there are programs that allow you to COPY all photo content from an iPod but this is not what i am looking for.
I want to do this because I want to keep the Saved Photos on my PC so when I restore my iPod I can still have 'em put in my iPod, since I will lose them restoring it..

Nevermind I just figured it out! I had to select NO EVENTS which made that whole section clickable and I unchecked what I didn't want on my iPod!

Hi, just wanted to let you know I have the same problem. I did a BING search and it came up with, you have to down load icloud for windows to your pc, then you sign in to your apple id, after you install the program. you will have to do photo sharing between all of your devices, and make a folder for it. walla pics. Hope this is somewhat clear enough, otherwise, try the BING search for your answer! Good luck

If you made an iCloud or iTunes backup of your iPhone you can use that to restore a new iPhone with your photos. If the photos were shared via PhotoStream you may be able to access them on a new iPhone or other device using the same iCloud ID.
