Trying to restore the iPod

a while a go, i had to send my iPod (engraved) into service because it started to react slowly and stuff (i chose not to get the engraved one back), a while afterwards i got a "new" iPod back (i have the 20GB version without a colordisplay "clickwheel")
the one i got back started to work fine, but just recently it acted all weird, causing iTunes to freeze, and the update the songs, and then it started to "disconnect from widows". That means that when i plug it in via firewire, windows and iTunes recognize it, but it "disconnects" itself before any songs are transfered/updated/deleted..
and when i try to restore the iPod from the iPod updater, i get a message saying "Firmwareupdate failed, Disk error" (directly translated from norwegian)
i've tried to reset the ipod and such but to no avail.
i've also tried to do any of the aforementioned steps to make it work, but it just dont wanna work anymore..
Im getting a bit tired of the iPod 4th generation clickwheel always experience problems, so i think im going to call Apple Europe/ Apple norway, or something like that and tell them that i want a brand new 5th generation iPod back since the price hasn't been raised at all. All i demand is a functioning iPod and since the clickwheel generation seems to have a lot of bugs and such, i think its fair and square that i get a brand new iPod back. (note that the iPod hasn't been "abused" physically)
well, thats my rant for today.
anybody know how i can fix this?

    Did you try to reset the device by holding the sleep and home button until the Apple logo comes back again?

    Place the iOS device in Recovery Mode and then connect to your computer and restore via iTunes. The iPod will be erased.

    If you restore from iCloud backup the apps will be automatically downloaded. If you restore from iTunes backup the apps and music have to be in the iTunes library since synced media like apps and music are not included in the backup of the iOS device that iTunes makes.

    Was that Apple ID and password the original owner of the iPod?  If not, try using the Apple ID and password of the original owner.

    Tried to restore my ipod I just wanted to back to factory setting and delete everything on it.  I did it and NOW everything is erased, gone, and stuck on the apple logo.  Populated that it is in recovery mode and needs to be restored.  Clicked on restored and error (1) came up.  So now I have a useless iPod that I purchased.  Big apple user minus my laptop.  2 iPod, 2 iShuffles, iPad, 4 iPhones, iMac 27 inch.  If this isn't rectified I will never buy and continue to push my consumers, family, and friends on my bad experience with apple.  iTunes is up to date and now I am concerned that if do anything to my phone this same problem will happen.

    Error 1 or -1 can be very tricky to resolve and sometimes leads to a device needing service.  That being said, here are the steps I would go through first for this specific error. 
    Check for hardware issues
    Try to restore your iOS device two more times while connected with a cable, computer, and network you know are good. Also, confirm your security software and settings are allowing communication between your device and update servers. If you still see the alert when you update or restore, contact Apple support.
    Common errors: 1, 10-47, 1002, 1011, 1012, 1014, 1000-1020.

    It means the device is in recovery mode.  You'll need to reconnect it to iTunes and restore it again.
    You may need to connect it in recovery mode manually using the instructions in this Apple support document.
