Was given a refurbished iPhone 5 by Verizon: what to do?

About 5 months ago I purchased an Apply iPhone 5 from Verizon with a contract, and was feeling good about it. All was well with the device, and looked completely brand new when I opened the packaging.
However, yesterday, following about 5 months of joy from the iPhone the screen started going black for extended periods of time. Then after awhile it would come back on. I have never dropped the phone or allowed it any water damage or anything, so I decided to call Apple to get it looked at. However, they told me there was no warranty on the device, as it had previously been replaced. My initial reaction was, "What? I've never gotten this replaced? I mean, I bought it brand new, or so I thought." I talked to a guy at Apple and he said that sometimes carriers give out refurbished phones on accident or purpose, to customers, who assume they are buying a brand new product. The only time you are guaranteed to get an 100% brand new phone, is when you buy it from an Apple store.
So, I'm a little upset, because now there is no warranty for the phone and I'm stuck with one, which does not work.
What do I do? I feel if I call Verizon they will say "SOL." Nothing we can do.

The iPhone 5 is a great phone, but I am sorry to hear that you are having issues with the device. We absolutely want to make sure we get you back up and running.
I can assure you that the phone is brand new.  If the phone was Certified Pre-Owned it would have been marked as such on the box that it came in.
Does the screen go black when you perform a specific function?  Please try a soft reset,http://vz.to/RfHijN.
Every device we sell comes with a one year manufactures warranty, so if you're still within that time frame we can replace it at no cost to you as long as there is no physical or water damage.

    Hi everyone,
    I'm extremely outraged right now.  I lost my phone a few weeks ago (it happened to get reset the day before so no Find My iPhone or iCloud) and was without a phone for an entire week before buying a new one at full retail price at a Verizon wireless store.  Tonight, I was approached by my neighbor who asked me if I ever got my old (lost) phone back.  He said he found it the same night I lost it and brought it to the Verizon store near me (the same one I bought my new, very expensive phone from).  Apparently they told him they would E-mail me to tell me they had my phone.  Well, no one E-mailed me (obviously).  So now I'm extremely frustrated.  Having thought my phone was stolen, I bought a new one-- only to find out the very store that sold me it currently has my old phone and made absolutely no attempt to contact me.  Further, I BOUGHT a new phone from THAT store.  There was no note on my account saying my phone was brought in?  I mentioned several times it was lost too.  My question is this: given the circumstances is there any way for me to get my money back for the new phone I bought?  I'm just really baffled and furious that absolutely no attempt was made to return my phone to me.  I'll be going to the store tomorrow to speak with a manager but was wondering if anyone had any advice for what to do about this situation.

    I went to the store today and they said they didn't see it in any of the 'spots' they'd have put a phone they received nor was there a note on my account about it at all.  As far as my neighbor goes, he's not someone I've spoken to before.  He found the phone near my car and I guess didn't know who I was at the time so he called Verizon and they told him to bring the phone in and they would contact the owner.  Yesterday he saw me getting out of my car last night so he approached me about it.

    I purchased a "new" iphone 4 after my first one was dropped in some water. I paid around $580. 4 days later, my wet iphone started working again, so I was pretty happy I could return the new one. When I went to the wireless wave location, they said there had to be less than thirty minutes talk time for it to be returned; no problem! Big problem! I had only owned the phone for 6 days, but there was 8 DAYS of TALK TIME on the phone in total! It wasn't even mathematically possible! The manager was more worried about whether or not I had actually used it for the 30 minutes. He couldn't have cared less that I had obviously paid full price for someone elses discarded cell phone without knowing it! I need some advice on how to handle this! I called an Apple location and they said they do NOT condone selling any refurbished Iphone products and were not aware of this. I sent an email to apple's legal email, but honestly I am just so frusturated. I tried contacting wireless wave, but obviously they don't want to talk to me. I was given no explanation at the time of return as to why there would be 8 days of talk time on a "brand new" iphone 4. They were actually trying to call my provider and make sure I hadn't used it for more than the allotted time. I was given a refund after just about losing my cool on the poor guy working there. He was in fact very nice and very understanding, but could offer no help besides giving me a refund.  My husband and I have purchased many phones from the certain wireless wave location, and I can't help but wonder how many other used products we have purchased!

    It's not an Apple issue and Apple has nothing to do with it.
    The only way to buy an iPhone officially refurbished by Apple is to buy it from an Apple store or via Apple's website.
    Refurbished iPhones sold via other retailers are not refurbished by Apple.
    Sounds like Wireless Wave did all they could... they refunded your money.
    Your only issue is with them.  Stop getting all worked up over it.

    The official method of creating / escalating to a complaint is to call support, with previous call numbers handy, and request the representative to escalate your case to a complaint.  They will then create a complaint on your behalf and also be able to inform you about the complaints proceedure.

    I'm really annoyed that the battery in my iphone 5 loses it's charge so quickly, won't even make it through the day. I turned off some of the notifications and other features that I don't use but it doesn't seem to make any difference.

    It is very frustrating when you have to frequently charge your phone. Help has arrived and we are able to assist with your battery needs. With a fully charged battery please dial #2539 and leave the line open for 10 minutes. An automated announcement will play. Review the current battery level after the test call. Let us know how much the battery drained.

    You plug it in to iTunes and then click on the restore option.

    A refurbished device is a used ine that has been completely restored to new. If Apple exchanges yours for a refurbished one, your original device will be refurbished for someone else. The refurbished devices are indistinguishable from new ones. You won't even know if you've gotten one. My iPhone is a refurbished device. I chose to buy it as it was $50 cheaper than a new one.

    Wrong. accordomg to MacRumors, all 5C Verizon iPhone are sold unlocked and will work on AT&T and T-mobile as well.

So when it was given to me, I had it restored and updated via iTunes to iOS 5.1. I bought a micro-sim and inserted it on the sim tray. iTunes was able to detect the SIM card number and there was NO MESSAGE like the sim card is not supported whatsoever which can be usually seen in unsupported simcard. I thought everything went smoothly. But when I tried to set-up the phone, the SLIDE TO UNLOCK button is unresponsive. It doesn't work so I was stuck there and my iPhone cannot be accessed because of that. What shall I do? I have tried doing the hard reset several times, it still didn't work. I have tried restoring my iPhone three times but the slide to unlock is still unresponsive. I think the iPhone was able to detect my carrier simcard since it shows on the top corner the name of my carrier, mobile signal and 3g network. Now I am wondering as to why the slide to unlock button is unresponsive? Was it because of my iPhone LCD or was it because the iPhone is locked? Please help.

    according to some blogs, if the sim card you are using is unsupported, iTunes will show you a message that the sim card you are using is unsupported. But when i opened itunes, I didn't see that message. Instead, it was able to detect my sim card number. So I guess, the simcard is supported. It isn't the original sim, though. Then the phone was able to detect the mobile carrier, mobile and 3g signals. So iam wondering whether my phone is locked or was it a hardware problem?

    If you are saying that you both have iCloud accounts and use the same icloud ID, then yes, the contacts will be deleted.  The idea is that all devices using the same icloud ID are kept in sync.  You need to use different IDs.  You can keep the same iTunes ID so you can share the songs and apps.  But use different icloud IDs.

    You cannot delete the iCloud account that is signed on to Find My iPhone unless you know the password. This is called the Activation Lock:
    ACTIVATION LOCK
    It is an anti-theft security measure that is a part of iOS 7. You can only get around this by following the steps in this support article:
    Find My iPhone Activation Lock: Removing a device from a previous owner’s account
    Contact your friend. This is the only way around the lock.

    her contacts are connected directly with the Google Server so as long as they are saved to her Gmail account she should be 100% fine.. the only contacts she may lose are the ones that she added directly onto the phone and did not sync to her Gmail account.. so you should just double check with her on that

    The iphone is designed to be synced to your computer or cloud service.  Your contacts should be in whatever program/service you have chosen to sync.
    If you have failed to do this, then they are likely gone.

    From what you describe it sounds like the phone is in recovery mode. Try connecting the phone to the wall charger that it came with, and perform a reset then connect it to iTunes again and try:
    Reset
    You should reset your device as a last resort and only if you can't restart it.
    To reset, press and hold both the Sleep/Wake and Home buttons for at least 10 seconds, until you see the Apple logo.
