What will happen if I return refurbished iPod?

I made a stupid mistake when I recently ordered a refurbished iPod Nano for my girlfriend for Christmas.
I just didn't realize that the refurbished unit was a 1st generation iPod; I thought I was buying her a 2nd generation unit.
So, what will happen if I return the iPod? The box has been opened and she has used it for a couple of days. Will there be a restocking fee or anything of that sort?

I wonder if their "All products must be packed in the original, unmarked packaging" applies to refurbished products that just come in a plain brown box?

    Would the PC automatically update my iPod? I know there is a setting in iTunes where I could choose if iTunes updates my iPod automatically or manually, but I can't seem to find it. I'm afraid to connect my iPod now to my PC because this might erase and foul up my songs in my iPod.

    If your iPod is set to update automatically you just need to take care when connecting back to your computer and an empty iTunes. If it is set to automatically update you will get a message that your iPod is linked to a different library and asking if you want to link to this one and replace all your songs etc, press *No*. Pressing "Yes" will irretrievably remove all songs from your iPod. Your iPod should appear in the iTunes source list from where you can change the update setting to manual and use your iPod without the risk of accidentally erasing it: Managing Your Songs Manually
    You can also use a keyboard command to prevent your iPod auto-syncing with iTunes. While connecting the iPod to the computer on Windows hold down the Shift + Ctrl keys (on a Mac hold down the Option and Command (⌥ and ⌘) keys). This will stop the iPod from auto-syncing with iTunes and the iPod will appear in the source list. Wait until you are sure the iPod has mounted, and that it will not auto sync and then you can let the keys go. This may take between 20 to 30 seconds depending on your computer. Then go to Edit>Preferences>iPod and check the "Manually manage songs and playlists" box.
    You can't sync or drag your music back directly from an iPod to iTunes, the transfer of music is designed by default to be one way from iTunes to iPod. However there is a manual method of accessing the iPod's hard drive and copying songs back to iTunes on Windows posted in this thread: MacMuse - iPod to iTunes
    If you prefer something more automated then there are a number of third party utilities that you can use to retrieve the music files and playlists from your iPod, this is just a selection. Have a look at the web pages and documentation for these, they are generally quite straightforward.

    Whichever of these retrieval methods you choose, keep your iPod in manual mode until you have reloaded your iTunes and you are happy with your playlists etc then it will be safe to return it auto-sync again. I would also advise that you get yourself an external hard drive and back your stuff up in case you have problems again. External drives are comparatively inexpensive these days and you can get loads of storage for quite a small outlay.

    There's an answer to your question but first it's time for a little lecture - if it makes a difference, I don't feel any better about this than you do. ; - )
    I hope you take this unfortunate situation as an opportunity to learn a very important lesson: Back up your iTunes library as soon as you can after resolving this situation because right now you are only one glitch of your iPod away from losing your music entirely.
    Many people come to the Discussions having lost their music in just such situations and, believe me, it's not a happy time for anyone.
    If you place any importance on your playlists and the data they depend on, make sure to include the iTunes Library files in your back-up regimen as well.

    It would ultimately depend on how many points you were originally awarded for purchasing the iPad and how many points you had in your account when the return was processed.  Here are a couple examples of possible outcomes:
    If you had been awarded 500 points for the iPad and had 700 points in your account, then your balance would drop to 200 points and you would keep the $15 certificate.
    If you had been awarded 500 points and only had 300 points in your account, then the $15 certificate would be cancelled and your points balance would be 550.

    I am thinking of exchanging my 2 week old ipod for a new one b/c it has frozen 3 times already, althougth it has been easily reset. The store people ( circuit city) reccomended that I do so.     plug in the new ipod and it will sync your information..you do not have to uninstall the old ipod. its pretty simple.

    No body knows about the next gen of any Apple products, other than they always advance.  There are still many much older products in successful use so that should not be a problem.  My iPad original cannot use iOS 6.1.3 but it still does what I want and works great.
    If you have the 4th gen, use it aa long as it meets your needs.  If it doesn't look at the options for a new one at that time.

I've been using my iPod Video as a storage device as well as for music, and I'm going to do a clean install of Windows XP in the near future-my CD/DVD drive has somehow failed to respond (code 41), so reinstalling Windows to factory settings should do the trick. Only problem I can foresee is what will happen to all the data on my iPod when I reinstall the CD software for iTunes and my iPod drivers-will all the data on my iPod disappear when I reconnect it to my laptop for the first time?

    When the iPod is connected to the PC after reinstalling Windows, a message will appear asking you if you want to change the computer the iPod is associated with will appear if iTunes is installed; pressing Erase & Sync on this dialog box will delete all content on the iPod that was synced from iTunes. Content copied to the iPod outside of iTunes will not be erased by iTunes unless you explicitly restore the iPod.

    They are all saved, when you sign back in to you account(apple id) and go to the app store at the very end corner (bottom right) is were all your bought apps are saved.

    What do you mean by a reset? If you mean depressing the buttons until the Apple icon appear then no. How you resetdepends upon the model Nano.
    If you mean restore via iTunes, that erases the iPod.
