Why is the home button not working correctly?

I have reset the button by holding sleep key & home button down, i have also tried to reset the home button by holding this down itself, it is still none responsive most if the time. I have done this many times.
It is also very difficult to get it to open the 'open apps bar', so i can close these down!!
My ipad is only 4 days old and i feel frustrated to be having problems so soon!!!

Calibrate Home Button
1. Open a stock application like Calendar, Weather or Youtube
2. Hold down the power button until the "slide to power off" control appears
3. As soon as you see it, press the Home button and keep it pressed until the red slider disappears and the app is forced quit to the Home menu

Did you try another restore and this time not to restore from a backup and see if that makes a difference? This is what Apple would tell you to do next based on my iphone 5 fiasco.
Make sure all your data is available on your computer for manual syncing later.
Since you did the hard reset I assume that means your home button isn't broken only that it got frozen before. Were you able to get the Apple logo after the reset? Did it boot?
And you are using iTunes 10.7?

When building an iPad HTML5 app, why does the splash page not work correctly in landscape mode?

I have recently completed an HTML5 web app for the ipad and one of the most challenging things about the process was getting the splash screen to work.
I have now succesfully completed the job and the splash screen works, but only under the bizarre condition that the app is first launched in portrait mode. This seems pretty crazy as most people using the ipad for browsing do so in landscape mode.
Has anyone come across this problem and resolved it?

yes, bare in mind this is an HTML5 Web App and not a native app. so yes I have included code for both landscape and portrait modes.
I install the web app and open in portrait, it works. then close and open in landscape, it works.
if i install the app and open in landscape FIRST... then no splash screen ever works.
This isn't just my problem. I've read about in several forums over the past few days while investigating.

It's a minor annoyance, but still annoying to hear-feel the click yet still have to do it again

The girl said that restoring the phone would correct the problem which it did. But it is only a temporary fix, it happens more often now. So I was meaning to call in soon, but the other day my phone fell out of my pocket IN CASE from a foot height and cracked the screen. I nearly threw up. All the years I have had a phone I have never cracked or broken one, strongest screen my ***. Anyway, if I contact them again now will they fix the home button problem? or will they say that the cracked screen is obviously the cause of the home button not working? which it is not!! I don't care about the screen being cracked its not on the actual screen just on the side so its irrelevant to me. Plus I heard it is outrageosly pricey to replace.

Apple, as I said, does not repair your iPhone. All hardware service issues are handled by replacing the unit. So they can't handle the home-button issue without also addressing the issue of the cracked screen, for which they'll almost certainly charge you. But you can make an appointment at an Apple Store or call Apple tech support and plead your case.

This happened to me as well. AT&T had me reset my network settings and this fixed the problem. Here is how...
Settings > General > Reset > Reset Network Settings
"For now" the problem is fixed for me.

The screen repair was botched. Take iPhone back to place of screen repair, and have them get the home button working again.
