Why is this XML ng valid?

I am trying to create sample XML files as source for my RTF template, but when I try to load it I get the error: Please load XML data.
I created it with Reports 10, and it looks like this:

Ok I found it.
Sometimes (i haven't figured out why yet) when a column is empty and you generate XML with reports, it inserts & n b s p ; between the XML tags. These were not seen in my posting before and when I copied and pasted the code I pasted here the xml was valid.
When I compared the two XML files I noticed the difference.
The funny thing is: I select 4 clob columns of which the contents are empty_clob() (which is not null, since nvl doesn't change them), and 2 of them contain & n b s p ; between the XML tags and two don't. I understand that XML Publisher doesn't parse this and it shouldn't, so I am going to open up a service request for Reports to get to the bottom of this.....
