Class action lawsuit regarding Android 2.2

If there were a class action lawsuit filed against Verizon regarding the lack of support for upgrades of the Android OS, would you join it? Essentially it would be based on promises and claims made by sales reps at the stores during the decision process of buying the phone and by phone reps that the Samsung Fascinate was to receive the Android 2.2 update "any day now".
As it stands, people who purchased the Fascinate are paying full price for the data package just the same as other Verizon customers who purchased phones from competing manufacturers (Motorola and HTC). However, people who purchased the Fascinate are not getting the same access or experience as the customers who purchased phones from these other manufacturers.
If I purchased a less technically capable phone than the HTC Incredible or Motorola Droid X, I would not expect the same software updates. However, I was told that the three phones (Incredible, Fascnate and X) were all in the same class and all ran on the same version of Android (2.1 at the time of purchase). Being a Black Berry Storm user before and having been limited on my browser experience, I had been following the progress of Android and I had heard that Android was to receive an update that would allow for Flash capabilities which was a huge deal. It was one of the main reasons I switched from Black Berry to Android. I was told that all three phones would be receiving the 2.2 update "very soon". This was in October of 2010.
Due to the Adobe Flash capabilities provided by the Android 2.2 update, Fascinate users are being limited on their browser usage but are not being compensated in ANY way for this lack of access. Also, other Samsung products contracted through Verizon are already come with the Android 2.2 software installed.
Personally (and I don't think I'm alone), I feel cheated by both Verizon and Samsung for not providing what was promised, all the while, people who purchased the Motorola or HTC handsets, have received their updates as promised and are receiving more browser access but paying the same amount that I am. Upon calling Samsung, the rep did not hesitate to blame Verizon for the lack of support.
So the question again is... If there were a class action lawsuit filed against Verizon, would you join it? There may never be one, and many attorneys may say it would be a waste of time, but would you join? I know I would.

I am totally disagreeing with you. When you're purchasing a car, dealership is clearly asking telling you that car is sold AS-IS and you even being asked to sign a letter of release form that states that car is being purchased with whatever option currently existing on the car and unless specifically specified no additional accessories or parts are coming with it. BUT and notice it is a capital letter but...it also say NO PROMISES, VERBAL, WRITTEN, OR OTHEWISE BEING MADE TO OFFER IN CONJUNCTION WITH THIS SALE.
And that it what you are signing.
In Verizon case, verbal promises of Froyo availability were made by Verizon sales, tech, and sups left and right. It is time to make those companies to be accounted for their actions.
About 3 weeks or so I spoke with one law firm in San Francisco in regards to that matter and they were willing to open the class action case against Verizon. I was quite busy in the past and hadn't have a chance to speak with them again. I will try to make up some times next week to come see them again and proceed with a case.

    I notice I'm not the first to report this issue.  In fact, after reading the horror stories in the community, I'm questioning if going with Verizon Wireless and/or using their online trade-in program was the right thing to do.  I see so many other people experiencing the same nightmare, I figure it's just a matter of time until there's a Class Action Lawsuit against them regarding their Trade-in Scam of 2014.
    I was lured to Verizon by their promotion of receiving $200 for my iPhone 4s.  I pre-ordered my iPhone 6 online on 9/12.  Following the check-out, I was given the option to complete the online trade-in program.  My iPhone 4s was in perfect condition as it was kept in a LifeProof case since day 1.  Being in that condition made it eligible for the full $200 trade-in value.
    My iPhone 6 arrived on time.  I transferred my data from the iPhone 4s to the iPhone 6.  Then ensured the 'find my phone' feature was turned off, all passwords unlocked and factory reset completed.  Then I fully charged the phone and turned it off prior to packing into the provided trade-in program materials/envelope.
    I was a little concerned about the trade-in program materials/envelope.  The envelope itself was nothing more than a padded envelope.  It was a pre-printed business reply envelope.  No tracking number other than a bar code with my submission id on it and then stamped with the word PROMO.  I was hesitant to drop it in a mailbox so I took it right into my local post office.  That was on 9/23.
    I started checking the trade-in status a week later but the status was 'Not Received'.  Another week later, same thing.  Finally, I reached out to the trade-in program via email on 10/11.  I received a 'canned' response back on 10/16 that I should wait 4-6 weeks for my gift card.  That time period includes a 2-3 for inspection and processing from the date of receipt at the warehouse.
    On 10/25, I reached out again to the trade in program via email.  On 10/26, I received the very same response... word for word.  I reached out again on 11/7 and they didn't even reply.  I tried calling but got no where by phone.  They claim they'll escalate the issue but I never hear back.
    I really feel scammed out of $200 by using this online trade-in program.  The guideline stipulated that I must use the supplied packing materials and envelope or the promotion amount would not be guaranteed; however, without tracking there is no way to know where the phone is.
    Come on Verizon...  you lured me in, now do the right thing and send me the $200 gift card I was promised.

    I've gone through the same process as you've described with a different twist. They advised me that the screen on
    my phone was cracked. They are sending me $36 instead of the Appraised Value of $200.  I'm not an Attorney
    but I would bet it would be an easy win over Verizon in a Class Action, because this whole process smells
    bad. There must be tens of thousands of people getting ripped off and they're not all liars, which is what Verizon would have a judge believe. Contract or no contract, most states prohibit Agreements that would negate consumer protection
    from fraudulent business practices.
    Verizon may play hardball with it's disenchanted customers and there isn't much you can do as an individual.
    This just happened with me on one phone and I'm waiting for news of a second phone that I sent at the same time.
    In the meantime I will visit the Verizon Store and talk to the salesperson who sold me the two new iPhone 6's
    and see what he can do. I will also contact my local Better Business Bureau office for their advice. If there's no satisfaction, I will keep the phones, stop paying my bill and get a new carrier. They can take me to court, but I will be there first in@ Small Claims Court. I'm retired so I have time to do this stuff, but most people can't, so the best bet is still a
    good Lawyer with a Class Action Suit and lots of negative publicity in the papers and the internet.

    An anonymous FaceBook page with no real information seems more like one unhappy customer looking to rant than a person seriously considering legal action against HP Inc...
    To be taken seriously, I'd suggest you list your name, the Legal Group you have retained for this lawsuit, and where and when you plan to serve papers, the goal(s) you plan to gain, and what each member of this legal action can possibly receive - otherwise you have little credence, IMHO.

  • Pavilion DV2000 Class Action Lawsuite (over heats and battery doesn't work)

    Hello HP and to whom it may concern -
    I was recently laid off and I had to turn in my work laptop so I pulled my HP Pavilion DV2225NR out again after it being in storage for well over a year to see if I could make some progress to get it to work again since I had some time.  I have seen some information online regarding a class action lawsuite due to hardware problems.  At one point, I even took my notebook back to BestBuy where I purchased it and it was returned for repairs more than once and it still never worked properly.  I've invested a lot of time and effort this past week to try and get what I paid good money for several years ago to work properly.  I also own a HP Pavilion desktop and wonder if it also hardware problems and that is why it doesn't seem to work properly anymore either.  I'll be checking into that one as well. 
    All I want is a laptop that works and either that this one be repaired at no cost to me by HP or that they replace it with a comparable and working machine.  
    I look forward to hearing from HP as I really need equipment that I paid for to work now more than ever so that I can use it to find another job.

    I am sure there will be no thanks or kudos but I will try to give you some kind of an answer. The dv2000 and similar models with AMD processor were one of the largest group of defective products released onto the U.S. market, but it was in 2007 and 2008, or 5 to 6 years ago. HP issued an enhanced warranty but you had to ask that it be fixed within 2 years. It was not a recall. The problem is the nVidia video chip and nVidia was sued in a class action and offered repairs and cash damages but that closed maybe 2 years ago. The long and the short of it is all your consumer rights have expired. HP will not fix it free or provide you a new laptop. These things have time limits just like if you get hurt in a car wreck. You can't wait longer than the statute of limitations and then ask for a remedy. There are shops that will fix them for around $100 and if you are still communicating I can help you with this. We are sorry to hear of the job loss and wish you good luck. We do not work for HP we are volunteer peer-to-peer helpers.

    I have been thinking about buying a sound card that is certified for windows vista. However after seeing so many unsatisfied and angry people, no way I'm buying anything for now.
    So many people complain about issues with drivers and windows vista; I remember we had the same issue happen when the NVIDIA 8xx video card was introduced. The drivers didn't work. They caused some system to crash, and so on... I also remember a class action lawsuit threat was placed on NVIDIA.
    I didn't follow up with it enough to know if the lawsuit was actually set into motion or not, but NVIDIA has been updating their drivers very frequently lately.
    I would imagine the people who have purchased creative labs sound cards can easily band together and do the same. After all, a lot of websites have a "Vista Certified" logo for creative labs sound cards like the X-FI version, which obviously are not really "certified" because they don't work. This is false advertisement imo.

    The Class Action thus far has not been settled. So while your display in question may be part of the suit, I would not worry about it until it is.

    I already had all of the features turned off, had 20% free, all transparency were turned off and a few apps were on refresh and now are all turned off.
    Like I said, my phone worked fine until I installed IOS 8 and now the screen will freeze intermittingly and runs very slowly when searching it. In other words IOS 8 significantly diminished the operation of a perfectly good phone and Apple will not let you roll it back to IOS 7. They F’d up my phone intentionally to sell us all the latest model.

I think what your guys are trying do do is a this CASH CRAB and this is not Right. SO

    We will release Vista drivers for the products we stated we are releasing Vista drivers for on the Vista driver chart. To my knowledge we are currently meeting all legal obligations pertaining to Vista driver support. If this is not satisfactory to you you can feel free to contact Customer Support with your suggestion to release drivers for older products. However, this thread is not appropriate for this forum and is now locked.

    Comcast Wake up!!! --  your billing practice and customer service is horrible--  you are ripping your customers off Please let me know how to facilicate a lawsuite -- Class Action Lawsuite against the biggest injustice -- and fraudulent billing practice! Can someone please help me and tell me where to sign or how to initiate a class action lawsuite? Comcast is the worst company in the world. Its a monopoly and rips off customers. This is my second experienced dealing with Comcast. The lure you in with affodable pricing but when you want to disconnect or downgrade your service -- you are out of luck and get ready to be screwed no matter how reasonable and responsive you are.

    If you try to disconnect services they pile on you new fines and charges. They never pick up the equipment and charge you for not returning their equipment. Takes them 60 days to respond to a disconnect request and then takes them 30 more day after that to disconnect you. Meanwhile they keep charging you and if you dispute the charges there is noone to speak with and the charges keep mounting. Their customer service are clueless and have no power to make any decision. They keep apploogizing on the phone but they have no idea where to look and what to do.
    They try to exhaust you and they hold the key and they hold the charges.Let me know where PLEASE - we need to put a stop to this!!!! -- this is the WORST customer service and billing practice experience I have ever seen. I am not a complainer -- never sued anyone or disputed bills but this has been a blood boiling infuriating experience. Someone has to pay!

    YOU may not be able to phycally sue comcast...  but the FCC , FTC and Attorney General can on the behalf of you and several others. Those agencies are the neutral parties ... they won't sue unless you take action first, you have to file a complsint, simply follow the prompts and copy & paste your complaints. It's less effort than going back and forth here and will help even better. Definitely complain to Comcast,  why? Because there needs to be documentation that you informed them of dissatisfaction and complained. It's unfortunate but we've let these larger companies get away with it so they are out of normal reach... don't support Comcast, fire them just like you hired them for services. Write a letter to them , whatever you have to do its worth your peace of mind. I'll say this last, if you stay, you pay. If you just talk about it nothing will change and you contribute to their bad practices by not complaining , kinda like the bystander effect, everyone knows it's wrong but no one says anything. I don't care if I don't get but $1 of my money back, it's the principal and sometimes you gotta hit their pockets even if the money is spread 800,000 ways, yes Im saying don't expect a huge payday from a class action lawsuit so make sure it's the principal of the matter. That's what it takes. 5 minutes of your time to complain vs hours on the phone.

    "The California Superior Court granted final approval of settlement on August 25, 2005. Under the terms of that order and settlement, Apple is not required to begin the process of fulfilling claims until the judgment and order in the case is final, which occurs only after the time for appeal expires and no appeal is filed or, if an appeal is filed, after that appeal is resolved by the California Court of Appeal. On October 24, 2005, just prior to expiration of the appeals period, two individuals filed an appeal from the judgment and order approving the settlement. As Class Counsel, we are in the process of responding to that appeal, which we believe to be without merit. However, until that appeal is withdrawn, dismissed, or resolved by the Court of Appeal, Apple cannot be legally required to begin the process of fulfilling claims, or pay Class Counsel's attorneys' fees and expenses. We are working as diligently as possible to have this appeal dismissed and/or resolved by the California Court of Appeal.   • NVIDIA chip class action lawsuit

    Today I received an e-mail from NIVIDA saying that my macbook pro may be one of the various macbook pros that has a faulty NIVIDA chip. It claims that various NIVIDA chips have already failed and blah blah blah. you can read more about it if you don't know what I'm talking about.

    Probably only if Apple refuses to replace the board the second time. Although rare, there are a few reports of people having the replacement fail, but have usually been able to get another repair.
    I've read over the settlement and basically I don't see much applicability to most Apple owners. Apple has a program in place that both addresses needed repairs and will reimburse someone who had a LB replaced before the Repair Extension Program was issued.
    I say work with Apple as long as you can. The only people who come out ahead in a CA lawsuit are the lawyers.

    @ Zer0K3wL2, Who did you talk to who said they would refund you?  I paid almost $400 for this coulda-woulda-shoulda-been-an-android-tablet.  I even tried to donate it to a developer at xda, and apparently, they don't even want the ****** thing. I would LOVE to get my money back so I can go ahead and upgrade (to a Nexus)...  And I absolutely promise that if Sony gives me my money back in exchange for this tablet, Sony will NEVER see me as a customer again (of course, they're already never going to see me as a customer again...  Then again, do they even see me as a customer now?). But, ****** yeah...  Who do I talk to in order to get unswindled? Thanks.

    My family has fallen subject to the most famous misconception of plan change.  My mother went in to check out new phone options.  Long story short what do you think happened?  Yes, they neglected to explain to her the effects of a plan change.  They neglected to tell her about non reversal plan changes, only she has 14 days to return the phone, they neglected to explain to her what was actually changing in the plan and how it would effect others associated with the plan.
    Seeing all the complaints with the Better Business Bureau and via many many online forums including this one I think something needs to be done.  People are being misled into irreversible contracts.  Something seriously is wrong. 

    I am currently battling with Verizon for changing my daughter's data plan from 4g to 2g several months ago (August 2013), without my permission, and I only recently (Feb 2014) found out after my daughter grew frustrated and asked me to look into it. The last several months I was giving her an earful for using up her data plan too soon.  They don't tell you what amount was  being used, only the %. Had the amount used been transmitted, we would have caught it sooner.  So although they admit it was their fault (luckily I saved the chat) and the rep tried to put in a restore order, it was denied because they said they no longer had that plan available. So they thought I was just going to accept it.
    Restoration was requested & denied twice, so now I told the rep (who is very nice) to tell them that they had better figure out something else because this is not sitting well with me. In August 2013, I had called to have some foreign calling option removed from my non-data phone line, and apparently the rep decided to reduce another line's data plan. When I discovered the change, the first rep I talked to actually told me that I requested it. Sure, because I want to cut the data plan in half and pay the same amount?! I gave them one week to figure out what they are going to do.

    I'm an exsisting customer with an env2 there is'nt an upgraded phone without a data plan? even went to a store to have a customer service agent say keep your env2 till it dies we dont currently have a phone without a data package that's an upgrade to that one.

    Welcome to Verizon, the land of paying for features you don't want to earn the privilege of using a cellular device that meets your needs. Don't worry, the verizon staff and other data defenders will be along shortly to tell you all about how you have "choices" and how "simple feature" AKA basic, low quality phones meet the needs of anyone who doesn't like paying extra for a stupidly tiny 25MB data package every month.
    In the meantime, I would start researching other carriers if any of them have good coverage in your area.
