Clicking into PS CS6 from another app

Question

I'm doing a series of screen captures and clicking into PS from the browser is cause PS to "grab" the layer on click on. It hold the layer in the "closed hand" cursor until I click again.
To be clear:
2 monitor setup
New machine: Dell XPS 8500 24gb RAM
Nvidia GeForce GT 640
Intuos 5
Win 8
My layers menu is on screen 2, browser for screenshots is in screen 1. Process is:
- Take screen shot
- click layer to switch into PS (cursor is a horizontal-scale cursor at this point - horizontal line with arrows at each end)
- PS grabs layer
- Have to click to "drop" layer
Alt tabbing works fine.
Clicking in empty area below the layers works fine.
This is new behavior and clicking the layers menu is part of my work flow. Not sure why this is happening now.  Any help would be appreciated.
Also, I recognize the work-arounds, the goal is to not have to use them. Don't need to have work arounds pointed.  just looking to understand why this is happening.
