If these were synced photos, they won't be included in the backup that you can make via iTunes or iCloud, but since they originally were synced from your PC, they should still be there.

Yes, you need to restore. Here is how:
Plug your iPod into a computer with iTunes
Go into your iPod's section on the bar on the left hand side of iTunes
Click restore
Confirm the restore with the dialog boxes that pop up.
When it is done, if you have a recent backup of your iPod in iTunes, you can tell it to use it.

Back up your phone in iTunes before updating or restoring the phone with iOS 6. Then you'll be prompted to choose between restoring the data on the phone before the update/restore or setting it up as new. Your pictures should still be there afterward as long as you dont set up your phone as a new phone. My pictures on both my iPhone 4s and iPad 2 were still there after I did it.
Its also best to go to your iPhones camera folder and copy all the pictures to your computer.

I should just change the OS and leave all your apps and data alone. That said, if any of your apps are old and use Rosetta (ppc apps), they won't run under Mountain Lion.
Make sure you take a good Time Machine or Clone backup before you convert.

Restoring an iPod has no affect on iTunes or your library. Restoring will erase the iPod's hard drive, reload the software and put it back to default settings, so if you have songs on your iPod that aren't on iTunes you will lose them if you have no back up. You should be OK if you synced/backed up your iPod. If you didn't, you will need to go download and install the apps again. The good news is, you won't have to pay for them again.

- What is the source of the photos? If they were taken by or saved to the iPod then they may be in the backup of the iPod. Go to iTunes>Preferences>Devices and look at the date of the backup.
