If not caused by accidental damage, the iPod Touch includes a one year warranty. If your iPod Touch remains under warranty, you can call AppleCare or make an appointment at an Apple store if there is one nearby. If the iPod Touch remains under warranty you open the iPod Touch youself or by a 3rd party, doing so will void the warranty. If you live near an Apple Store, make an appointment to see if the store can get the button unstuck. If not under warranty, there won't be any charge for this.
