You can try and restore it from the computer to which you've previously synched. If this does not work, you'll have to force your phone into recovery mode and restore as a new device. All your data will be wiped.

If you bought it second hand then had the previous user removed their account from Settings > iCloud (and had Find My iPad enabled) on it ? I notice you are looking for solutions other than restoring, the article does outline how you can use iCloud's Find My iPhone:
