Hide me I'm the background

Question

Looking at the scriptlistener am I to understand it's slightly more complex than one item to hide the background layer?

It seems only true when the background layer is the only layer in the document.
And what you do is to make a normal layer (the name is changed to Layer 0). 
With at least 2 layers,
app.activeDocument.backgroundLayer.visible = false
works well and the bg layer stays the bg layer. That was the question, no ?
My version is CS4.
